Calendar of Obligations
State Marshals have certain statutory mandates based on their appointment. Failure to comply with the required actions can subject a state marshal to disciplinary action by the State Marshal Commission. The following is a guide to help state marshals note important dates.
May 1 or as ordered by Office of State Ethics
Under C.G.S. Section 1-83 state marshals are required to file a Statement of Financial Interest (amounts and sources of income) with the Office of State Ethics (OSE). State Marshals obtain the form from the OSE web site www.ct.gov/ethics and must return the form to OSE (not the State Marshal Commission.) Non-compliance could lead to a $10,000 fine by OSE and /or disciplinary action by the State Marshal Commission.
May-June
Not Mandatory. State Marshals are given the choice of obtaining health insurance from the entities that provide state employees health insurance, at the state rate. State marshals, however, have to pay the full cost of the premiums. Enrollment notices are sent each year in a window period. State marshals can enroll, or not.
July 1
Pursuant to C.G.S. Section 6-30a state marshals are required to carry personal liability insurance to cover damages caused by tortuous acts, and any actual or alleged act, error, omission, neglect or breach of their duties while conducting state marshal activities. The insurance must be not less than the following amounts: For damages caused to any one person or property of any one person or to the property of more than one person, three hundred thousand dollars. Other provisions can apply if a state marshal engages in capias work.
Each state marshal must renew their insurance annually and a copy of their insurance certificate needs to be on file with the State Marshal Commission.
October 1
C.G.S. Section 6-38 requires state marshals to pay an annual fee of $750.00, sent to the State Marshal Commission for the General Fund. The checks from the state marshals are made payable to the Treasurer of the State of Connecticut.
Year Round
Restraining order duty in domestic cases is rotated among the state marshals on a weekly or daily basis depending on the county and courthouse. See C.G.S. Section 6-38 (g). State Marshals are required to maintain coverage of their assigned duty dates. The assignments are distributed by the Commission.
