Temporary Order to Cease and Desist, Notice of Intent to Issue
Order to Cease and Desist, Notice of Intent to Impose Civil Penalty
On March 3, 2011, the Commissioner issued a Temporary Order to Cease and Desist, Notice of Intent to Issue Order to Cease and Desist, Notice of Intent to Impose Civil Penalty and Notice of Right to Hearing (“Notice”) in the Matter of:  American Mortgage Auditors, Inc. (“Respondent”).  The Notice alleged that Respondent offered to engage and engaged in debt negotiation in this state without obtaining the required license, in violation of 36a-671(b) of the Connecticut General Statutes, and collected fees which did not comply with Section 36a-671b(b) of the Connecticut General Statutes and the schedule of maximum fees established by the Commissioner.  The alleged violations form the basis to issue an order to cease and desist pursuant to Sections 36a-671a(b) and 36a-52(a) of the Connecticut General Statutes, and to impose a civil penalty pursuant to Sections 36a-671a(b) and 36a-50(a) of the Connecticut General Statutes.  The Commissioner also found that the public welfare required the issuance of a Temporary Order to Cease and Desist and ordered the repayment of fees pursuant to Section 36a-671a(c) of the Connecticut General Statutes.  Respondent was afforded an opportunity to request a hearing with regard to the allegations set forth in the Notice.

On March 3, 2011, the Commissioner issued a Notice of Intent to Issue Order to Cease and Desist, Notice of Intent to Impose Civil Penalty and Notice of Right to Hearing (“Notice”) in the Matter of:  Matthew Smith and YourMortgageRights.com a/k/a YourMortgageRights.org a/k/a ModPilot, Inc. a/k/a ModPilot.com (“Respondents”).  The Notice alleged that the Respondents offered to engage in debt negotiation in this state without obtaining the required license, in violation of Section 36a-671(b) of the Connecticut General Statutes.  The alleged violation forms the basis to issue an order to cease and desist against each Respondent pursuant to Sections 36a-671a(b) and 36a-52(a) of the Connecticut General Statutes, and to impose a civil penalty upon each Respondent pursuant to Sections 36a-671a(b) and 36a-50(a) of the Connecticut General Statutes.  Respondents were afforded an opportunity to request a hearing with regard to the allegations set forth in the Notice.
