Danbury Jury Convicts New York Man of Assault and Attempted Robbery Charges

12/10/2021

FOR IMMEDIATE RELEASE

(Danbury, CT) – Stephen J. Sedensky III, Danbury State’s Attorney, today announced that a jury has found Rodney D. Harvey, 29, of Bronx, New York, guilty of multiple charges stemming from an attempted robbery that occurred on May 23, 2018 in Danbury. The jury found Harvey guilty on December 8, 2021 of Attempted Robbery in the First Degree, Accessory to Assault in the First Degree, Accessory to Assault in the Second Degree, Assault in the Second Degree, Conspiracy to Commit Robbery in the First Degree and Assault in the First Degree.

The evidence presented at the six-day trial in Danbury Superior Court showed that Harvey and two other individuals entered a residence in Danbury where they proceeded to stab two victims numerous times while attempting to steal illegal drugs. The three individuals fled the residence. After a thorough investigation by the Danbury Police Department, the three individuals were later arrested. Testimony at trial included DNA evidence from the state Department of Emergency Services and Public Protection laboratory, the FBI, and extensive testimony from members of the Danbury Police Department.

In November 2021, co-defendant Collin Hedley pleaded guilty to Assault in the First Degree, Attempted Robbery in the First Degree and Conspiracy to Commit Robbery in the First Degree. He faces 10 years in prison when he is sentenced next year. The other co-defendant, Diego Trejo, died in a car crash while his criminal case was pending.

Harvey faces a maximum of 70 years in prison. He is scheduled to be sentenced before Superior Court Judge Robin Pavia early next year. The case was prosecuted by Deputy Assistant State's Attorney Kristin Chiriatti. Harvey was represented by Attorney Jeffrey D. Hutcoe.
