Chief State’s Attorney’s Meeting

The meeting was called to order at 12:45 p.m. by Chief State’s Attorney Kevin T. Kane.
In attendance were: Deputy Chief State’s Attorneys Leonard C. Boyle and John J. Russotto; State’s Attorneys Richard J. Colangelo, Jr. (Stamford-Norwalk), Michael Dearington (New Haven), Gail P. Hardy (Hartford), Kevin D. Lawlor (Ansonia-Milford), Peter A. McShane (Middlesex), Maureen Platt (Waterbury), Brian Preleski (New Britain), Michael L. Regan (New London), Stephen J. Sedensky III (Danbury), David Shepack (Litchfield) and John C. Smriga (Fairfield); and Assistant State’s Attorney Matthew Crockett (Windham).
Also present: Executive Assistant State’s Attorneys Brian Austin, Jr., and Michael A. Gailor, legislative liaison Wilfred Blanchette and Communications and Legislative Specialist Mark A. Dupuis.
State’s Attorney Sedensky made a motion to accept the minutes of the October 19, 2015, meeting. The motion was seconded by State’s Attorney Smriga and passed unanimously.
Deputy Chief State’s Attorney Boyle reported on draft changes to Division of Criminal Justice Policy 501, “Use of Force and Firearms.” A vote will be taken at the next meeting.
State’s Attorney Preleski reported that the Operations Committee has completed its review of Division policies concerning response to incidents involving deaths resulting from the use of force by police. The draft language is being circulated among Inspectors for their input.
There was discussion of concerns raised at the November meeting by State’s Attorney Regan concerning the issuance of arrest warrants for violation of a civil protection order absent proof that the order was personally served on the respondent. Chief State’s Attorney Kane will discuss the concerns with the chairs of a legislative task force on domestic violence issues. Possible legislation will be drafted.
Deputy Chief State’s Attorney Russotto reported on the state deficit mitigation process now under way. The Office of the Chief State’s Attorney is preparing caseload analyses to assist in the process for documenting to the Office of Policy and Management the need for filling vacancies.
All State’s Attorneys are asked to report to Deputy Chief State’s Attorney Russotto by Friday, November 20, 2015, with specific tasks and responsibilities that have added to the Division’s workload. These will be compiled into a list to assist in quantifying the demands placed upon the Division.
Chief State’s Attorney Kane reported on recent developments with the Governor’s “Second Chance Society” initiatives and other studies under way in preparation for the 2016 session of the General Assembly.
State’s Attorney Platt reported that the question of whether the provisions of Public Act 15-183 concerning the transfer of cases from the juvenile to regular docket is retroactive will be presented to the Connecticut Supreme Court.
Executive Assistant State’s Attorney Austin reported on upcoming training opportunities. Division Policy 324, “Conferences and Seminars,” is being revised and the draft language will be circulated for consideration at the next meeting.
