In Attendance: Maureen Platt, Chair, Denise Covington, Patti LaMonica, Candida Fusco, Laura Cordes and Ana Doroghazi
The meeting was called to order at 2:03 p.m.
The subcommittee discussed the need for an implied consent provision in the Technical Guidelines. The following language was discussed as a possible option:
When clinically indicated as determined by a licensed health care provider examining an unresponsive patient, the examiner may conduct an exam of the patient and collect evidence using the CT-100 and CT-400 kits, when the examiner believes that the patient will not regain the ability to consent within a reasonable period of time. Such kits shall be treated as anonymous kits. If said patient remains unresponsive, and is not expected to become responsive within a reasonable period of time, a law enforcement agency may notify the State's Attorney's office where the crime is believed to have been committed. Said State's Attorney may seek a court order allowing the processing of the evidence kits.
It was agreed that the members would discuss this proposed language with their respective groups and affiliated organizations in order to further discuss and refine this proposed language at the next meeting.
The next meeting of the subcommittee was scheduled for February 26, 2013, at 2 p.m. at the Office of the Chief State’s Attorney, 300 Corporate Place, Rocky Hill.
