Contracts in SFSP
Section 7 CFR 226.2 “Food service management company” of the Summer Food Service Program (SFSP) regulations defines a food service management company (FSMC) as "any commercial enterprise or nonprofit organization with which a sponsor may contract for preparing unitized meals, with or without milk, for use in the Program, or for managing a sponsor's food service operations in accordance with the limitations set forth in § 225.15. Food service management companies may be: (a) Public agencies or entities; (b) private, nonprofit organizations; or (c) private, for-profit companies." The requirements for SFSP sponsors that contract with a FSMC are addressed in 7 CFR 225.15(m) and the applicable sections of the SFSP regulations below.
- 7 CFR 225.6(l) defines the requirements for monitoring of FSMC procurements.
- 7 CFR 225.7(c) requires that state agencies develop and make available to all sponsors minimum food specifications and model meal quality standards which shall become part of all contracts between vended sponsors and food service management companies.
- 7 CFR 225.17(f) requires that all contracts in excess of $10,000 must contain a clause allowing termination for cause or for convenience by the sponsor including the manner by which it will be effected and the basis for settlement.
