Contracts in CACFP


Section 7 CFR 226.2 “Food service management company” of the Child and Adut Care Food Program (CACFP) regulations defines a food service management company (FSMC) as "an organization other than a public or private nonprofit school, with which an institution may contract for preparing and, unless otherwise provided for, delivering meals, with or without milk for use in the Program." The requirements for CACFP institutions that contract with a FSMC are addressed in 7 CFR 226.21 and the applicable sections of the CACFP regulations below.

  • 7 CFR 226.6(i) defines the requirements for the state agency standard contract.
  • 7 CFR 226.6(j) requires CACFP institutions to adhere to the procurement provisions of 7 CFR 226.22. CACFP institutions must determine that all meal procurements with FSMCs conform to the bid and contractual requirements of 7 CFR 226.22.
