Release-Based Cleanup Regulations Formal Regulation Adoption
The proposed Release-Based Cleanup Regulations have been revised. A draft of this regulatory package was previously shared with the working group and the public on December 29, 2023. The current, proposed regulations have been modified from that draft to incorporate recommendations and advice from the working group and comments and discussions with the public. The formal regulation adoption process has begun. The public notice comment period will last 90 days.
The proposed Release-Based Cleanup Regulations have been posted in the eRegs portal for public comment. Please use the (unlocked) Public Comment Form to make your comments, then upload them in the eRegs portal by October 24, 2024. This will help staff organize and respond to comments. If you have submitted comments through an organization, please do not submit the same comments as an individual.
An unofficial redline version of Proposed Release-Based Cleanup Regulations is posted for your convenience. This version show, in track changes, revisions made to the draft shared with the Working Group on December 29, 2023. In sections 9 and 10, additions to the cleanup standards proposed in the December 29, 2023 are highlighted, and revisions to that language is shown in track changes. To ensure that DEEP's regulatory proposal is clearly articulated to the various stakeholders, including those that were not available to participate frequently during the working group process, DEEP will offer informational meetings and is available to speak at constituent meetings.
