My neighbor is building an addition to their condo, and it comes onto my property. What can I do?

Have you spoken with the other condo owner? Is he or she aware that they’ve built onto your property? Does the condo association agree that there is an encroachment? If your condo association agrees, then the association is required to take action against the violating condo owner. Representatives should first speak with the owner and discuss possible remedies. It may be possible to resolve the problem without further conflict.

Sometimes further action must be taken. The condo association may impose fines against the owner, and in some cases may wish to attach a lien to the condo owner’s property requiring that the problem be fixed upon its sale. Finally, the association may take the owner to court.
