Emergency Burn Ban In Effect 10/26/24 - An emergency burn ban is now in effect for all Connecticut State Parks, Forests, and Wildlife Management areas, prohibiting the use of all outdoor grills, firepits, and campfires, and the kindling and use of flame outdoors. Notice of Tentative Determination of Intent to Renew a Discharge Permit into the Waters of the State of Connecticut

1.0 TENTATIVE DECISION
The Commissioner of Energy and Environmental Protection ("the Commissioner") hereby gives notice of a tentative determination to renew a permit based on an application submitted by Wieland Rolled Products North America, LLC ("the applicant") under Section 22a 430 of the Connecticut General Statutes for a permit to discharge into the waters of the state.

In accordance with applicable federal and state law, the Commissioner has made a tentative decision that continuance of the existing system to treat the discharge would protect the waters of the state from pollution and the Commissioner proposes to renew a permit for the discharge to the Naugatuck River.

The proposed permit, if issued by the Commissioner, will require that all wastewaters be treated to meet the applicable effluent limitations and periodic monitoring to demonstrate that the discharge will not cause pollution.

2.0 APPLICANT'S PROPOSAL
Wieland Rolled Products North America, LLC proposes to discharge 288,000 gallons per day of day of process wastewaters (metal finishing and copper forming), de-ionized regeneration wastewater and laboratory wastewater and incidental rainwater to the Naugatuck River from operations at a precision
re-roll mill. Process wastewater will undergo equalization, two stage neutralization, metal precipitation and clarification prior to discharge to the Naugatuck River.

The name and mailing address of the permit applicant are: Wieland Rolled Products North America, LLC, 215 Piedmont Street, Waterbury, CT 06706.

The proposed activity will take place at: 215 Piedmont Street, Waterbury, CT 06706. The discharge will enter the Naugatuck River approximately half mile south of the confluence of the Mad River and Naugatuck River, on the eastern side of the Naugatuck River.

3.0 REGULATORY CONDITIONS

Effluent Limitations

This permit contains effluent limitations consistent with 40 CFR 433 and 40 CFR 468 Best Available Technology (BAT); Best Practicable Technology Currently Available (BPT); a Case-by-Case Determination using the criteria of Best Professional Judgement; Section 22a-430-4 of the Regulations of Connecticut
State Agencies; and water quality based effluent limits, which will ensure compliance with the Connecticut Water Quality Standards when the permittee complies with all permit requirements. 

In accordance with Section 22a 430 4(l) of the Regulations of Connecticut State Agencies, the permit contains effluent limitations for the following types of toxic substances: heavy metals, phenols, and volatile organic compounds. 

Compliance Schedule

This permit contains a compliance schedule which requires the applicant to:
       1.   Submit a per – and polyfluoroalkyl substances (PFAS) sampling plan for the 
             Commissioner’s review and approval; and 
       2.   Propose alternative actions and implement the preferred action(s) to achieve compliance 
             with the pH effluent limitations contained in the permit.

4.0 COMMISSIONER’S AUTHORITY
The Commissioner of Energy and Environmental Protection is authorized to approve or deny such permits pursuant to section 402(b) of the Federal Water Pollution Control Act, as amended, 33 USC 1251, et. seq., and Section 22a 430 of the Connecticut General Statutes and the Water Discharge Permit Regulations (Section 22a 430 3 and 4 of the Regulations of Connecticut State Agencies).                                        
 
5.0 INFORMATION REQUESTS

Any interested person may request in writing that his or her name be put on a mailing list to receive notice of intent to issue any permit to discharge to the surface waters of the state.  Such request may be for the entire state or any geographic area of the state and shall clearly state in writing the name and mailing address of the interested person and the area for which notices are requested.

6.0 PUBLIC COMMENT

Prior to making a final decision to approve or deny any application, the Commissioner shall consider written comments on the application from interested persons that are received within thirty (30) days of this public notice. Written comments should be emailed to Oluwatoyin Fakilede at oluwatoyin.fakilede@ct.gov. The Commissioner may conduct a public hearing if the Commissioner determines that the public interest will best be served thereby or shall hold a hearing upon receipt of a petition signed by at least twenty-five persons. Petitions should include the application number noted above and identify a contact person to receive notifications. Petitions may also identify a person who is authorized to engage in discussions regarding the application and, if resolution is reached, withdraw the petition. Original signed petitions may be scanned and sent electronically to deep.adjudications@ct.gov or may be mailed or delivered to:
