Notice of Tentative Determination to Approve Application to Construct and Operate Volume Reduction Plant/Composting

The Commissioner of Energy and Environmental Protection (“DEEP”) hereby gives notice that a tentative determination has been reached to approve the following application submitted under Section 22a-208a of the Connecticut General Statutes (“CGS”).

Southeastern Connecticut Regional Resources Recovery Authority (“Applicant”) seeks authorization to operate a Solid Waste Volume Reduction Plant. The facility is proposed to be located at 132 Route 12, Preston, CT and will consist of: a scale house and scale; a receiving and mixing building for Food Waste, eight composting bays on a concrete slab; four curing windrows on an asphalt surface; a finished compost screening area (5,000 cubic yards); and two storage areas – one for a compost sales stockpile (5,000 cubic yards) and one for wood chips (3,000 cubic yards). The facility will accept Food Waste and woodchips from SCRRRA member towns and commercial customers only. The Applicant requests to receive and Process no more than fifty-five (55) tons per day of Food Waste. The Applicant may store no more than 3,000 cubic yards of woodchips on-site or 100 cubic yards of Food Waste. The site is 33.7 acres, but the facility will occupy 7.5 acres. Operating hours are Monday thru Saturday 6:00 a.m. to 7:00 p.m.

Interested persons may obtain a copy of the application from the applicant’s contact noted above.  The application and supporting documentation are available for inspection at DEEP, Waste Engineering and Enforcement Division, Bureau of Materials Management and Compliance Assurance, 79 Elm Street, Hartford, CT from 8:30 a.m. to 4:30 p.m. Monday through Friday and at other times by appointment.  Questions may be directed to Kevin Clements of the Solid Waste Permitting Program at (860) 424-3545 or Kevin.Clements@ct.gov.

Before making a final decision on this application, the Commissioner shall consider written comments on the application from interested persons. Written comments on the application should be directed to Kevin Clements, Waste Engineering and Enforcement Division, Bureau of Materials Management and Compliance Assurance, Department of Energy and Environmental Protection, 79 Elm Street, Hartford, CT 06106-5127, or may be submitted via electronic mail to Kevin.Clements@ct.gov no later than thirty (30) days from the publication date of this notice.

PETITIONS FOR PUBLIC HEARING

The Commissioner may conduct a public hearing if the Commissioner determines that the public interest will best be served thereby or shall hold a hearing upon receipt of a petition signed by at least twenty-five persons.  Petitions shall be submitted within thirty (30) days from the date of publication of this public notice and should include the application number noted above and identify a contact person to receive notifications. Petitions may also identify a person who is authorized to engage in discussions regarding the application and, if resolution is reached, withdraw the petition. Upon receipt of a petition, the Commissioner shall take action as required by relevant laws, including Public Act 25-84, which was effective upon passage in June 2025. The Office of Adjudications will accept electronically filed petitions for hearing in addition to those submitted by mail or hand delivered. Petitions with required signatures may be sent to deep.adjudications@ct.gov; those mailed or delivered should go to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106. If the signed original petition is only in an electronic format, the petition must be submitted with a statement signed by the petitioner that the petition exists only in that form. Original petitions that were filed electronically must also be mailed or delivered to the Office of Adjudications within 30 days of electronic submittal.
