REGULATORY CONDITIONS
The proposed activities include the following: installation of a fish ladder at Upper Mill Pond Dam, sealing sinkholes, addition of an 83-foot-long by 8-foot-wide by 6-inch-deep low-permeability blanket, filling of the large voids in the spillway face, dry-chinking the spillway face, reconstructing the spillway with a 2-foot-wide concrete cap that includes an 8-foot-long by 12-inch-deep notch with a fish return plate and an 8-foot-long by 4-inch-deep notch to assist with spring and fall flows, restoring and leveling the crest, placement of large rock at the base of the dam, re-contouring of the streambank downstream of the dam, and removing trees on or near the dam.
There will be a permanent impact of 3,444 square feet (sf) and a temporary impact of 1,387 sf to the Indian River and associated wetlands.

PETITIONS FOR HEARING
Petitions for a hearing shall be submitted within thirty (30) days from the date of publication of this public notice and should include the application number(s) noted above and also identify a contact person to receive notifications.  Petitions may also identify a person who is authorized to engage in discussions regarding the application and, if resolution is reached, withdraw the petition.  Upon receipt of a petition, the Commissioner shall take action as required by relevant laws, including Public Act 25-84, which was effective upon passage in June 2025.  The Office of Adjudications will accept electronically-filed petitions for hearing in addition to those submitted by mail or hand-delivered.  Petitions with required signatures may be sent to deep.adjudications@ct.gov; those mailed or delivered should go to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106.  If the signed original petition is only in an electronic format, the petition must be submitted with a statement signed by the petitioner that the petition exists only in that form.
