Notice of Intent to Renew the General Permit to Construct and Operate a Commercial Facility for the Management of Recyclable Materials and Certain Solid Wastes
TENTATIVE DETERMINATION
The Commissioner of the Department of Energy and Environmental Protection ("DEEP") hereby gives notice that a tentative determination has been reached to renew, with minor clarifications, the General Permit to Operate a Commercial Facility for the Management of Recyclable Materials and Certain Solid Wastes.
COMMISSIONER’S FINDINGS/REGULATORY CONDITIONS
The proposed general permit, if reissued, will allow the aggregation of greater than ten (10) cubic yards of recyclable materials and certain solid wastes, provided certain conditions are met, at aggregation locations throughout the state for those materials and wastes.
CURRENT REGISTRANTS
Current Registrants shall complete and submit a registration and appropriate fee for the renewal of their registrations, in order to maintain their authorization to operate, no later than 60 days after reissuance of this general permit. PROPOSED GENERAL PERMIT
The purpose of the general permit is to allow the aggregation of recyclable materials and certain solid wastes at aggregation locations for those materials and wastes. The general permit also allows for limited processing of certain materials and wastes at the aggregation locations. The recyclable materials and certain solid wastes authorized in the general permit are: asbestos containing material; ash residue; clean wood (including leaves and grass clippings); construction and demolition waste; non-RCRA hazardous waste and compatible solid wastes; recyclable materials; and universal waste. Pursuant to Governor Lamont’s Executive Order 7M, the Commissioner extended the expiration date for the general permit from February 2, 2021 to May 3, 2021.
COMMISSIONER’S AUTHORITY
The Commissioner is authorized to issue this general permit pursuant to sections 22a-208(a)(i) and 22a-254(e)(1) of the Connecticut General Statutes. The Commissioner is authorized to approve or deny any registration under this general permit pursuant to CGS sections 22a-208a(i) and 22a-254(e)(1).

Interested persons may obtain a copy of this public notice, the proposed general permit and the general permit fact sheet on the DEEP website at www.ct.gov/deep/publicnotices. Due to ongoing COVID -19 emergency, the DEEP office located at 79 Elm Street, Hartford, is closed to the public. Before making a final decision on this proposed general permit, the Commissioner shall consider written comments from interested persons that are received within 30 days from the publication date of this notice.
