Notice of Tentative Determination Intent to Continue in Effect and Renew the General Permit for the Construction and Operation of a Commercial Facility for the Management of Recyclable Materials and Certain Solid Wastes “Commercial GP”

TENTATIVE DETERMINATION

The Commissioner of Energy and Environmental Protection ("DEEP") hereby gives notice that a tentative determination has been reached to renew the Commercial General Permit.

The current general permit expires on July 26, 2026. By publishing this Notice at least 180 days prior to the expiration date of the current general permit, section 22a-6aa of the Connecticut General Statutes authorizes the current general permit to continue in effect. The current general permit will continue in effect until June 30, 2028, or until the Commissioner makes a final decision on the renewal of the general permit.

COMMISSIONER’S FINDINGS/REGULATORY CONDITIONS

In accordance with applicable federal and state law, the Commissioner has made a tentative determination that continuing the general permit in effect would not cause pollution of the waters of the state. The proposed general permit, if renewed, will require registration for authorization to construct and operate a solid waste facility under the general permit, including re-registration for existing permittees.

PROPOSED GENERAL PERMIT 

The purpose of the general permit is to provide authorizations for small-scale management of recyclables and certain solid wastes, in a manner that is consistent with the state-wide Solid Waste Management Plan, the federal Resource Conservation and Recovery Act and protects waters of the state. The General Permit authorizes the aggregation of greater than ten (10) cubic yards of recyclables and certain solid wastes. Registrants and notifiers must specify the aggregation locations for those wastes. The wastes addressed in the general permit are those generated at locations different from the aggregation locations identified by the registrants and notifiers. The general permit also allows for limited processing of certain wastes at the aggregation locations. The recyclables and certain solid wastes authorized in the general permit are: Recyclable materials; Asbestos Containing Material; Ash Residue; Clean Wood (including leaves and grass clippings); Construction and Demolition waste; Non-RCRA hazardous waste and compatible solid wastes; Universal waste and compatible solid wastes; and food waste.

COMMISSIONER’S AUTHORITY 

The Commissioner is authorized to issue this general permit pursuant to sections 22a-208a and 22a-454 of the Connecticut General Statutes. The Commissioner is authorized to approve or deny any registration under this general permit pursuant to section 22a-6 of the Connecticut General Statutes.

Interested persons may obtain a copy of this public notice and the proposed general permit on the DEEP website at portal.ct.gov/DEEP/About/Public-Notices or by sending a request for an electronic copy to DEEP at deep.weedpubliccomments@ct.gov. The proposed general permit is also available for inspection at the DEEP offices located at 79 Elm Street, Hartford, CT.
