Fees

Applicants who qualify as innocent landowners and/or municipalities, Connecticut brownfield land banks, or economic development agencies are not required to pay the BRRP fee.  Other applicants are required to pay the BRRP fee.  Please submit associated fees to the Central Processing Division of the Department of Energy and Environmental Protection (DEEP) with a completed Fee Transmittal Form. Upload documents to the DEEP Remediation Division Secure File Transfer (SFT) website and also submit a copy to decd.liabilityreliefprogram@ct.gov

 

Base Fee

The total base fee is equal to 5% of the assessed land value as stated on the last-completed grand list of the relevant town (at the time the application is submitted). Please provide a copy of the current property card or the latest grand list.  The fee payment is split into two equal installments and submitted to DEEP using the BRRP Payment Form as follows:

First installment:

  • 50% of the total base fee due
  • Due within 180 days from purchase of the property or issue of BRRP approval letter (the “approval”), whichever is later.

    Second installment:

  • The remaining balance due (50% of the total base fee)
  • Due no later than four years of the approval.

Second installment:

  • The remaining balance due (50% of the total base fee)
  • Due no later than four years of the approval.

Fee Extensions:

  • Extensions for installment due dates may be granted upon request based on applicant’s progress and any unavoidable delays in remediation.
  • An extension request can be submitted to DEEP for either installment prior to the due date(s).No extensions will be granted if DEEP has not been notified of the request prior to the passing of such due dates.
  • Please submit schedule extension requests to DEEP.brownfields@ct.gov and copy DECD.LiabilityReliefProgram@ct.gov. 

Fee Reductions

First installment:

  • Reduced by 10% if the Completion of Investigation Report approved by a Licensed Environmental Professional (LEP) is submitted to DEEP within 180 days from the DECD approval into the BRRP Program.Please use DEEP forms for submission (follow Transmittal of Documents).

Second installment:

  • Eliminated if both the Remedial Action Report and Verification or Interim Verification are submitted to DEEP within four years from the DECD approval into the BRRP Program.
    • If DEEP approval or notification is required and is not issued within 60 days of submittal, the deadline for the second installment fee shall be extended by the number of days that DEEP decision is delayed beyond the 60 days.
      • If DEEP requests supplemental information as part of the review process, the extension shall not include the number of days taken by the entity to respond to DEEP.
  • Reduced by (or refunded in the amount equal to) twice the reasonable environmental service costs of a completed investigation (if applicable), documented, and approved by an LEP and submitted to DEEP, that demonstrates that the investigation of the nature and extent of any contamination that has migrated from the property has been completed in accordance with prevailing standards and guidelines. Such reduction or refund shall not exceed the amount of the second installment fee as described above.

Transferee Fees

If a municipality, Connecticut brownfield land bank or economic development agency (municipality and municipal-type entities) that has previously been accepted into the BRRP transfers its ownership of the subject property:

  • The prospective (private) purchaser of the subject property shall pay to DEEP the BRRP fees expected of an applicant as if it were applying to the DECD directly.The fees will be based on the most current grand list.There are no concessions on the fee unless the municipality and municipal-type entities submit a partial or full fee waiver request to the DECD (please submit to DECD.LiabilityReliefProgram@ct.gov.)
    • The following factors will be considered for any fee-waiver request:
    • Site located in a distressed municipality;
    • Project has significant economic impact;
    • Project has significant community benefit;
    • Eligible party is a governmental or nonprofit entity; and
    • Required fee is burdensome and will have a detrimental effect on the overall success of the project.

If a private entity (entity that is not a municipality or municipal-type entity) that has previously been accepted into the BRRP transfers its ownership of the subject property:

  • The prospective purchaser of the subject property shall pay to DEEP the greater of A) any unpaid fees due or B) a fee of ten thousand dollars.
