Liquor permits are issued to specific addresses and premises as drawn on your sketch in your liquor permit application. You cannot use the permit anywhere other than address displayed on the printed permit. If your business needs to move to a new location, this process is called a “removal.” A removal may be necessary due to:
- Hardship: an event out of your control, for example, eviction judgement, fire, landlord issues, unsafe structural or unhabitable conditions, financial strain; or
- Voluntary business decision: a decision that is made to improve the business through expanding, upgrading, or relocating to a new desired area.
To file a removal application, your permit must be active, in good standing and operational in your existing location, and you must have a right to occupy your current premises. This means you should:
- Submit any upcoming renewal.
- If you are facing eviction, losing access to your current premises, or otherwise are not operating your business, request a voluntary suspension of your permit.
A removal application is similar to your initial application, but streamlined. You will be required to obtain and submit:
- Proposed new premises address
- Approval of local officials for new address (zoning, town clerk, and fire marshal)
- Lease or right to occupy the new premises
- Backer financial statement
- Endorsement forms (if needed, such as patio, additional consumer bars, or entertainment)
- Stipulated Agreement for Removal
- Removal on Stipulation (if needed; allows you to remove immediately if you are facing a hardship that is beyond your control)
After your removal application is received, reviewed, and approved, you will be sent a placard for your new address. You must post the placard and complete the notification period. An agent will inspect your new premises. If all requirements are met, your removal will be approved and your permit updated to reflect your new address. You may then move your business to your new premises.
NOTE: You may remove immediately if you are facing a hardship beyond your control at your current premises, such as eviction, structural damage, infestation, safety issues not addressed by your landlord, or other emergencies that prevent your occupancy or operation in your current premises. You must request a Removal on Stipulation, which allows you to relocate and continue operating while the full removal review is pending.
