How is dining space measured for restaurant permits?

Restaurant permits (LIR and LRW) must have dining seating for 20 people and dining space of 400 square feet per statute and regulation.

  • Seats are counted by the number of available chairs at tables for patrons (sometimes called “table top count”)Seats at a consumer bar are not counted.

  • The dining space is measured from wall to wall, up to the seats or edge of any barWe aim to be as inclusive as possible. 

  • If the barroom is separate from the dining room, we will only count the space in the dining roomSpace in the barroom will not be counted. 

 

NOTE: If you alter your layout after your restaurant permit is issued, please contact Liquor Control so we can ensure your permit file is updated and that you still comply with seating and space requirements.
