The CT Autorenewal Law requires businesses get the consumer’s affirmative consent to the automatic renewal or continuous service BEFORE the consumer is charged for the good or service.
- Affirmative Consent means permission the consumer grants by doing or saying something, like clicking a button that says “I agree to the automatic renewal”
- This should be separate from, and in addition to, the consumer’s agreement to the transaction.
- It should be clear and easy for the consumer to understand that the agreement will continue or renew until the consumer cancels.
Examples of affirmative consent:
- an extra signature requirement before the consumer enters into the agreement
- a box for the consumer to check prior to entering into the agreement
It is strongly recommended that businesses obtain affirmative consent before the consumer enters into the agreement and in a manner that allows them to retain, and later show, the proof that the consumer provided affirmative consent. To determine if a violation occurred, whether the business has proof of the consumer’s affirmative consent will be a factor. A business will be asked for proof of a consumer’s affirmative consent when determining if a violation has occurred.
