What are legal risk adoptions?

A legal risk adoption happens when a licensed adoption home takes in a child who is not legally free for adoption. They would like to adopt the child but the child’s birth parents still have parental rights.

If we place a “legal risk” child with you it’s because we’d be happy to see you adopt them and believe we have a strong legal case to terminate parental rights. Unfortunately, that may not happen. If the birth parents keep their parental rights, the child must be reunified with them. That’s the legal risk.

Legal risk adoptions can be challenging but ultimately very rewarding. We recommend that you talk with your social worker and families that have cared for legal risk kids.
