Sec. 1. Sec. 10-183b. Definitions.

  • The proposal introduces new terms for administrative purposes: Co-participant, Disability Allowance, Formal application for Disability Allowance and Retired Member. The following existing terms are modified to more clearly state the meaning for a more proper administration of the plan:  Annual Salary, Average Annual Salary, Co-participant, Credited Interest, Designated Beneficiary, disabled, Employer, Funding, Member, Public School, Retired Member, School Year, Teacher, and educational role.

Sec. 2. Sec. 10-183c. Teachers' retirement system established. Benefits contractual.

  • The proposed amendments to this section make the administrative requirements more clear certain guaranteed benefits described in section 10-183g were moved to section 10-183j.  In order to retain the contractual guarantee with respect to those provisions, section 10-183j must be added to this section.

Sec. 3. Sec. 10-183e. Credited service.

  • The language was updated for clarification with regards to purchasing and earning service credit from September to June.

Sec. 5. Sec. 10-183g. Benefit rates. Commencing and ending dates.

  • The proposal adds language to make clear that credited service must be in the public schools of Connecticut and to conform it to other sections and deletes outdated provisions.  The proposal contains a change to more correctly state the alternative payment forms and time for payment under each and to clarify that the benefits described are effective after the member is eligible for retirement.

Sec. 6. Sec. 10-183h. Death benefits.

  • The proposal clarifies the benefit, deletes an outdated provision, add the required “in the public schools of Connecticut” and to change the reference to a definition to the correct term. 

Sec. 8. Sec. 10-183j. Benefit options. Period certain. Coparticipant's option. Retention of option after divorce.

  • The proposal adds language that defines the three types of benefit plan options as they are know: the Plan N, Plan C and Plan D options. In addition, the language is modified to correctly express the calculation of the death benefit amount.  The proposal also contains language to comply with other statutory requirements that the co-participant option shall not be terminated in the event of legal separation, on or after July 1, 2020.

Sec. 9. Sec. 10-183k. Termination of membership prior to retirement.

  • The proposal makes it clear that termination includes death or withdrawal of service and members are entitled to their contribution.

Sec. 11.  Sec. 10-183n. Duties of teachers' employers. Transmission of deductions.

  • If an error is made by the district regarding mandatory contribution, the district is responsible for any interest due.

Sec. 12. Sec. 10-183o. Payments to retirement board for persons in armed forces.

  • The proposal permits the employer to pay the mandatory contributions on behalf of a member in the armed services.

Sec. 14. Sec. 10-183q. Funds not assignable and exempt from attachment.

  • The proposal clarifies the permitted instances where the funds may be accessed: DROs, trustee to trustee transfers or rollovers.

Sec. 15. Sec. 10-183t. Health insurance: Plans maintained by Teachers' Retirement Board and boards of education

  • The proposal puts a limit on retro payments to districts for members receiving subsidy. Health subsidies increase $110 to $220, and $220 to $440 for members on district plans.

Sec. 19. Sec. 10-183aa.  Disability Allowance

  • The proposal addresses the definition of “active member” and eligibility for a disability benefit.

Sec. 20. Sec. 10-183ff. Erroneous payments; adjustment, repayment or refund. Erroneous invoices; purchase of additional credited service. Payment of benefits when material error in estimate of benefits statement.

  • The proposal allows the board’s discretion to reimburse bank charges. 

Sec. 21. Sec. 10-183gg. Part-time service. Determination of benefits.

  • The proposal deletes an outdated reference.

Sec. 22. Section 10-183jj.  Retirement incentive plans for teachers.

  • The proposal makes conforming changes to reference correct provision.

Sec. 24. Section 10-183pp.  Benefits readjusted for certain members.

  • The proposal makes conforming changes to reference correct provision.

Sec. 25. Section 10-183rr.  No credit for improperly certified teacher.

Sec. 27. Section. 10-66dd School professionals and persons holding charter school educator permits employed in charter schools.  Charter schools subject to laws governing public schools; exceptions; waivers.  Participation in the state teacher retirement system.

  • The proposal makes certain conforming changes to correctly reference a re-designated provision.

Sec. 29. Section. 10a-55i. Higher Education Consolidation Committee.

  • The proposal makes conforming changes to reference correct provision.
