DESIST AND NOTICE OF INTENT TO
IMPOSE CIVIL PENALTY

RIGHT TO HEARING        

WHEREAS, on May 23, 2011, the Banking Commissioner (“Commissioner”), acting pursuant to Sections 36a-50(a), 36a-52(a) and 36a-671a(b) of the Connecticut General Statutes, issued a Notice of Intent to Issue Order to Cease and Desist, Notice of Intent to Impose Civil Penalty and Notice of Right to Hearing (collectively “Notice”) against Respondent, which Notice is incorporated herein by reference;

WHEREAS, the Notice alleges that Respondent engaged or offered to engage in debt negotiation in this state without obtaining the required license, in violation of Section 36a-671(b) of the Connecticut General Statutes, which forms the basis to issue an order to cease and desist pursuant to Sections 36a-671a(b) and 36a-52(a) of the Connecticut General Statutes and impose a civil penalty pursuant to Sections 36a-671a(b) and 36a-50(a) of the Connecticut General Statutes;

WHEREAS, on June 1, 2011, Respondent received the Notice and, on June 13, 2011, Respondent requested a hearing on the Notice;

WHEREAS, since issuance of the Notice, the Commissioner became aware of additional information addressing the issues raised in the Notice;

WHEREAS, Section 36a-1-55(b) of the Regulations of Connecticut State Agencies permits the Commissioner to withdraw an order at any time before a final decision is issued;

AND WHEREAS, sufficient grounds no longer exist for the Commissioner to issue an order to cease and desist or impose a civil penalty against Respondent;

NOW THEREFORE, the Notice of Intent to Issue Order to Cease and Desist, Notice of Intent to Impose Civil Penalty and Notice of Right to Hearing issued on May 23, 2011, be and is hereby WITHDRAWN.
