Notice of Intent to Revise the State Implementation Plan
The Commissioner of the Department of Energy and Environmental Protection (DEEP) hereby gives notice of her intent to amend the State Implementation Plan (SIP). The proposed SIP revision will be submitted to the U.S. Environmental Protection Agency (EPA) for review and approval. The authority to adopt this SIP revision is granted by Conn. Gen. Stat. §§ 22a-5 and 22a-174. This notice is required pursuant to Title 40, Code of Federal Regulations (CFR) § 51.102.
DEEP is proposing to submit to EPA a revision to the State Implementation Plan (SIP) requesting that the following case-by-case volatile organic compound (VOC) reasonably available control technology (RACT) order be added to the SIP:
DEEP intends to issue Consent Order No. 20463 to Algonquin Transmission, LLC (Algonquin). Consent Order No. 20463 would establish a premises-wide emission limitation below the major source threshold for VOC, pursuant to Regs., Conn. State Agencies § 22a-174-32(c), at the facility located at 40 Woodruff Hill Road, Oxford, CT. Compliance with said emission limitation would exempt Algonquin from VOC RACT implementation at this facility.
A copy of the draft order is available for public inspection during normal business hours at DEEP’s Bureau of Air Management, Enforcement Division, 5th Floor, 79 Elm Street, Hartford, CT. The proposed SIP revision is also posted on DEEP’s website at the following location: Public Notices (ct.gov).
All interested persons are invited to comment on the proposed request. In accordance with 40 CFR § 51.102, DEEP will hold a hearing at the time and location set out below only if a request for such a hearing is made on or before September 30, 2026, at 4:00 PM Eastern.
