Project Description:
The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve this application to renew the Air Title V and Air Title IV permit for this power generating facility. Richard M Flynn Power Plant is a 150 MW combined cycle power plant with one emission unit, which consists of a combustion turbine with a heat recovery steam generator and a condensing steam turbine generator. The facility has associated exempt support activities which consist of an emergency generator and a diesel pump. Facility emissions are controlled by a Dry Low NOx Combustor within the turbine, in combination with water injection, to reduce oxides of nitrogen (NOx) emissions. Continuous Emission Monitoring System (CEMS) is used to monitor NOx, CO, wet and dry O2 emissions from the turbine. Fuel sulfur is monitored in the fuel oil on a per delivery basis.
The facility is subject to federal regulation 40CFR52 Subpart A – Prevention of Significant Deterioration (PSD), and 40CFR60, Subpart GG – New Source Performance Standard for Stationary Gas Turbine.
This Renewal includes the removal of the facility’s legacy Continuous Opacity Monitor (COM). The facility will be required to conduct an annual Method 9 test to verify compliance with opacity standards. The renewal does not authorize an increase in emissions. The permittee will be required to maintain records and report this data to verify compliance with permit conditions and limits.
Pursuant to the requirements of Section 7(2) of the Climate Leadership and Community Protection Act (CLCPA), the Department has requested and received information regarding the project’s consistency with CLCPA.
In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.
