Project Description:
The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve a Title V permit renewal and minor modification of a Title V permit (ATV Renewal 3), submitted by Consolidated Edison Company of New York Inc. for their existing permitted facility, Ravenswood Steam Plant, located at 38-54 Vernon Boulevard, Long Island City, NY 11101. The facility is an existing steam plant providing steam for commercial, institutional and residential use. The facility currently operates: Four (4) Babcock & Wilcox steam boilers, each rated at 424 MMBtu/hr., ducted through two stacks; and two (2) emergency generators. All boilers are permitted to fire on natural gas, distillate fuel oil, residual fuel oil, biofuel and renewable liquid fuel.
Renewal 3 application was noticed on February 17, 2021 but no permit was issued. Based on additional information received by the applicant, including a Part 231 analysis for the proposed use of additional fuel types and a revised source specific NOx RACT analysis, the Department is re-noticing the application. Also, during this period various regulatory updates occurred. These factors were addressed and the revised draft permit has been updated to reflect these changes.
The additions incorporated into the revised Renewal 3 permit are as follows: 1) a Part 231-11.2 condition to ensure compliance with the minor modification due to the addition of fuel types, distillate oil, renewable liquid fuel and biofuel;
2) a Part 201-6.5(a) condition to relinquish permit by January 1, 2030 as the facility proposed in their CLCPA analysis;
3) an updated Part 227-.2.5 (c) NOx RACT alternate limit condition; and 4) two conditions regarding greenhouse gas emission recordkeeping per Part 253-1.4 and 1.7.
Pursuant to 6 NYCRR 227-2.5(c) the draft permit contains a source specific NOx RACT limit 0.25 pounds per million British thermal unit (lb/mmBtu) that varies from the presumptive RACT limit 0.15lb/mmBtu for facility's four very large boilers. The application includes a re-evaluated NOx RACT analysis submitted by the facility which demonstrates that additional controls to achieve the presumptive limit are not economically or technically feasible. Process-specific Reasonably Available Control Technology (RACT) determinations that are included in this permit action will be submitted to the United States Environmental Protection Agency for approval as a revision to the State Implementation Plan (SIP).
There are no new emission sources and no emission increases proposed in Revised Renewal 3. Revised Renewal 3 will continue existing caps on total Hazardous Air Pollutants (HAPS) of 49,999 lbs/yr and 19, 999 lbs/yr for any single HAP.
As per the terms of the draft permit, the facility will remain subject to the provisions of 6 NYCRR Part 201-6, NYCRR Subparts 225-1, 227-1, 227-2, 40 CFR 63 Subpart JJJJJJ 40 CFR 63 ZZZZ and to the general provisions, notifications, recordkeeping, performance tests, compliance and monitoring requirements of all the regulations listed in this permit.
Pursuant to the requirements of Sections 7(2) and 7(3) of the Climate Leadership and Community Protection Act (CLCPA), the Department has requested and received information regarding the project’s consistency with the CLCPA.
In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)
It has been determined that the proposed action is not subject to CP-29.
