The Commissioner of the Department of Energy and Environmental Protection (“DEEP”) hereby gives notice that a tentative determination has been reached to approve the following application submitted under Section 22a-403 of the Connecticut General Statutes (“CGS”) for a permit. The Commissioner also intends to waive the requirement for public hearing pursuant to CGS Section 22a-403 provided that a hearing may be held if the Commissioner determines that the public interest will best be served thereby, or shall hold a hearing upon receipt of a petition as more thoroughly described below.

COMMISSIONER’S FINDINGS/REGULATORY CONDITIONS
The project is proposed to be completed in two phases. The proposed activities in Phase 1 include the following: raising portions of the embankment to the right of the spillway, flattening the downstream slope, flattening the upstream slope above the normal water surface elevation (WSE), installing a chimney and drainage blanket along the downstream slope, installing riprap along the downstream toe and along the upstream slope, raising the concrete core wall, extending the existing 24-inch low-level outlet pipe further downstream, abandoning the two existing 24-inch pipes from the spillway that discharge at the existing downstream embankment toe, and temporarily filling the spillway stilling basin with riprap to stabilize the
existing spillway structure until the new spillway structure is constructed in Phase 2.
The proposed activities in Phase 2 include the following: temporarily lowering the water surface in the impoundment to about 5 feet above the intake of the low-level outlet pipe, removing the temporary riprap in the spillway stilling basin, demolishing the existing concrete spillway and stone masonry training walls, constructing a new concrete spillway including training walls, spillway chute and stilling basin, installing riprap between the downstream end of the new spillway chute/stilling basin and the natural
downstream channel, raising the remaining portions of the embankment to the left and right of the spillway, flattening the remaining portions of the downstream slope and the upstream slope above normal WSE, and constructing a new pedestrian footbridge over the spillway. Upon completion of the work the impoundment will be filled back to the current normal WSE.
There will be a permanent impact of 4,447 square feet (sf) and a temporary impact of 135 sf for a total of approximately 4,582 sf of impact to New Milford Reservoir #4 and Town Farm Brook and associated wetlands.

PETITIONS FOR HEARING
Petitions for a hearing shall be submitted within thirty (30) days from the date of publication of this public notice and should include the application number(s) noted above and identify a contact person to receive notifications. Petitions may also identify a person who is authorized to engage in discussions regarding the application and, if a resolution is reached, withdraw the petition. Petitions shall comply with applicable laws, including Public Act 25-84, which took effect upon passage in June 2025. Upon receipt of a petition, the Commissioner shall take action as required by relevant laws.
Petitions shall be filed with the Office of Adjudications electronically through the E-Filing Service, https://deep-adjudications-cms-efile.ct.gov/. All initial and subsequent filings must be submitted through this system. Under special exception, petitions will be accepted by mail or hand-delivered. Those mailed or delivered should go to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106. If the signed original petition is only in an electronic format, the petition must be submitted with a statement signed by the petitioner that the petition exists only in that form. Original petitions must also be mailed or delivered to the Office of Adjudications within 30 days of electronic submittal.
