The Commissioner of Energy and Environmental Protection (“DEEP”) hereby gives notice that a tentative determination has been reached to approve the following applications submitted under Section 22a-208a of the Connecticut General Statutes. Subsequently, the existing Permit to Construct and Operate No.  0340946-MPCO issued on October 17, 2016, Permit to Operate No. 0340946-RPO issued on February 3, 2020 and Permit to Operate No. 0340199-RPO are longer in effect and are replaced by this Permit.

Facility Location: 283-285 & 307 White Street, Danbury, CT 06810

Facility maximum storage capacity: 22,005 cubic yards. The facility consists of: a site access gate and paved access road; a truck/scale house system; an enclosed 21,200 sq. ft. corrugated metal building (“Building 1”) to receive and Process C&D Waste; a concrete tipping floor including a steel plate push wall; a trailer load-out bay; chain-link and vinyl door enclosures for the 100’entrance; 16’ trailer load out area and two (2) 18’ rail car load-outs; areas dedicated for solid waste receiving, Processing and storage; and environmental control systems which include fire sprinkler, misting and ventilation; a fixed mechanical processing system in Building 1 with a design capacity of eighty-five (85) tons per hour ProTerra Solutions System, which includes a feed hopper, conveyors, screens, magnets, sorting house, manual picking station and conveyor used to recover Recyclable Items, material chutes, bunkers and a crane; an enclosed 2,000 sq. ft. rail car load out area adjacent to Building 1 with two (2) concrete pads, rail scale and rail spur; an enclosed 23,480 sq. ft. metal sided and roofed structure (“Building 2”) operating as an Intermediate Processing Center to receive, Process and storage commingled recyclables, paper, cardboard, and paper; a concrete tipping floor, chain-link and vinyl door enclosures; and fire suppression systems which include a dry sprinkler system, fire extinguishers and fire hydrant; a fixed mechanical processing system in Building 2 which includes a Model PRS 830D Disc Screener with a feed hopper with walking floor, walking incline conveyor, incline belt conveyor, picking station platform, disc screener, walking floor to baler, walking inclined baler feed conveyor, an HRB Baler unit, and storage binds for recyclables; an enclosed 13,800 sq. ft. metal sided and roofed structure (“Building 4”) operating as a Transfer Station to receive, store and transfer putrescible MSW; a concrete tipping floor with push walls; an outbound transfer loadout area for transfer via truck; chain-link and vinyl door enclosures; and fire suppression systems which include dry sprinkler system, fire extinguishers and fire hydrant; an enclosed 7,480 sq. ft. metal sided and roofed structure (“Building 5”) operating as in Intermediate Processing Center to receive, consolidate, storage and transfer commingled recyclable items, glass and paper and cardboard; receipt and storage of putrescible MSW in exigent circumstances only when no recyclables are present; a concrete tipping floor and material loadout area; chain-link and vinyl door enclosures; a 10’ x 20’ source separated glass bunker; and fire suppression systems which include mobile fire rover suppression system, fire extinguishers and fire hydrant; a separate residential drop-off area (“Mom & Pop Drop Off”) designed to consolidate putrescible MSW in a compactor and scrap tires in a container; a 236 sq. ft. (approximate) utility shed; three (3) buildings, Building 3, Building 7 and Building 8, that are used as offices and to conduct equipment maintenance; and fifteen (15) outdoor storage areas. 

The following waste materials may be accepted at the facility: (a) municipal solid waste (MSW), putrescible and non-putrescible; (b) oversized MSW items such as furniture, carpet and mattresses; (c) construction and demolition (C&D) waste; (d) clean wood including land clearing debris; (e) commingled glass, plastic and metal container; (f) newspaper and cardboard; (g) scrap metal including appliances containing chlorofluorocarbon (CFC) liquid; (h) scrap tires; and (i) recyclable items.

These applications have been assigned Nos. 202107954, 202210211, 202409993 and 202409994; please use these numbers when corresponding with DEEP regarding these applications.  Interested persons may obtain a copy of the applications from the applicant’s contact noted above. PETITIONS FOR PUBLIC HEARING

The Commissioner may conduct a public hearing if the Commissioner determines that the public interest will best be served thereby or shall hold a hearing upon receipt of a petition signed by at least twenty-five persons.  Petitions shall be submitted within thirty (30) days from the date of publication of this public notice and should include the application number noted above and identify a contact person to receive notifications. Petitions may also identify a person who is authorized to engage in discussions regarding the application and, if resolution is reached, withdraw the petition. Upon receipt of a petition, the Commissioner shall take action as required by relevant laws, including Public Act 25-84, which was effective upon passage in June 2025. The Office of Adjudications will accept electronically-filed petitions for hearing in addition to those submitted by mail or hand-delivered. Petitions with required signatures may be sent to deep.adjudications@ct.gov or via the Adjudication Docket Portal and E-Filing System; those mailed or delivered should go to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106. If the signed original petition is only in an electronic format, the petition must be submitted with a statement signed by the petitioner that the petition exists only in that form.
