The Commissioner of the Department of Energy and Environmental Protection (DEEP) hereby gives notice that a combined tentative determination has been reached to approve amendments to the following applications.
The initial Tentative Determination to approve these permits was published in the News Times on July 31, 2025. A Public Informational Hearing on the matter was held on January 8, 2026. After the Public Informational Hearing, the applicant requested to increase the Carbon Monoxide (CO) emissions limits in the four permits from a total of 3.25 tons per year to a total of 12.25 tons per year. The Commissioner has reviewed the requested increase and hereby gives notice that a combined tentative determination has been reached to approve these amended applications with the requested increase in annual CO emissions. The Commissioner also gives notice that a hearing may be held on these applications if requested in accordance with applicable law, including Public Act 25-84.

Interested persons may obtain copies of the application from the applicant at the above address. The application, proposed permits and supporting documentation are available for inspection at DEEP, Bureau of Air Management, 79 Elm Street, 5th floor, Hartford, CT, by appointment, Tuesday through Thursday from 9:00 AM to 4:00 PM. Appointments to view files can be made at hhttps://portal.ct.gov/deep/about/environmental-quality-records-records-center-file-room#appointment. All interested persons are invited to express their views on the tentative determination concerning this application in accordance with Sections 22a-3a-5(b) and 22a-174-2a(c) of the Regulations of Connecticut State Agencies. Written comments should be directed to Mr. James Grillo, Bureau of Air Management, DEEP, 79 Elm Street, Hartford, CT 06106-5127, no later than 30 days from the publication date of this notice. PETITIONS FOR HEARING
Petitions for a hearing shall be submitted within thirty (30) days from the date of publication of this public notice. They should include the relevant application numbers and a contact person to receive notifications. Petitions should identify a person authorized to discuss the application and, if a resolution is reached, to withdraw the petition. Petitions and any supportive motion shall comply with applicable laws, including Public Act 25-84, as codified at Connecticut General Statutes Section 22a-5e.
Pursuant to C.G.S. § 22a-5e, upon receipt of a petition and any supportive motion, and a determination by the Commissioner, a hearing may be held as either a contested case subject to the requirements of Chapter 54 or as an informational public comment hearing. Petitioners interested in a contested case must submit a petition with the required signatories and a timely supportive filing signed by the person(s) or authorized representative(s) of an organization that meets the requirements of C.G.S. § 22a-5e (b). The filings must also meet all other requirements of applicable sections of the Connecticut General Statutes and the Regulations of Connecticut State Agencies. Petitions shall be filed with the Office of Adjudications electronically through the E-Filing Service, https://deep-adjudications-cms-efile.ct.gov/. All initial and subsequent filings must be submitted through this system. Under special exception, petitions will be accepted by mail or hand delivered. Those mailed or delivered should go to the DEEP Office of Adjudications, 79 Elm Street, Hartford, CT 06106. If the signed original petition is in electronic format only, it must be submitted with a statement signed by the petitioner confirming that it exists only in that form. Original petitions must also be mailed or delivered to the Office of Adjudications within 30 days of electronic submittal.
