Notice of Tentative Determination that Resource Conservation and Recovery Act Corrective Action obligations are complete without controls for one portion of ABB Inc. and separation of 5.013 acres from the Main Site at ABB Inc. [aka Combustion Engineering (CE), Windsor] 2000 Day Hill Rd, Windsor, CT
The Department of Energy and Environmental Protection (DEEP) hereby gives notice that a tentative determination proposing Corrective Action obligations under the Hazardous and Solid Waste Amendments of the Resource Conservation and Recovery Act (RCRA) are complete without controls for the Fifth Portion (5.103 acres) owned by ABB Inc. (aka Combustion Engineering (CE)) located at 2000 Day Hill Road in Windsor (Main Site); and to separate the 300 Groton Road parcel of land referred to as the Fifth Portion from the Main Site.
Based on the environmental investigation and remediation conducted at the site, the Department has determined that remediation is complete for the Fifth Portion and neither an Operating nor a Post-Closure Permit is required. This means that the Fifth Portion will no longer be part of the property subject to the requirements of a Stewardship Permit (Permit No. DEEP/REM/SP/2021-7133) issued to ABB Inc.

Requests for Public Comment
The Commissioner will not make a final decision regarding this proposed “complete without controls” determination and separation of the Fifth Portion until the public comment period has closed and all received comments have been evaluated and addressed.
All interested persons are invited to express their views on the tentative determination concerning this draft Statement of Basis. Verbal comments provided during the Public Meeting will be considered.
