Consolidated Notice of Intent to Issue Modification to a Beneficial Use Determination Authorization

 The Commissioner of the Department of Energy and Environmental Protection (“Department”), pursuant to Connecticut General Statutes Section 22a-209f, hereby gives notice of intent to issue a modification to a Beneficial Use Determination Authorization (“Authorization”, “BUD-013”) issued to Green Earth Triangle, LLC (“the Applicant”) on December 24, 2020 for the beneficial reuse of treated dredged sediment (i.e., dredged sediment stabilized by a pneumatic flow treatment mixing process, PFTM) from the former Triangle Plastic Wire and Cable Site at 235 East Main Street in Griswold, Connecticut as structural fill for redevelopment of such site.  The requested modification is based on Application No. 202406792 received on May 28, 2024.  The Commissioner has found that the modification to the Authorization is not inconsistent with the requirements of the federal Clean Air Act, Clean Water Act or Resource Conservation and Recovery Act and that the authorized activity will not harm or present a threat of harm to public health, safety or the environment. 
 
The modification to BUD-013 will continue to allow the Applicant to use sediment dredged from marine and freshwater sources which have been treated to render contaminants immobile (“treated dredged sediment”), as engineered fill to support the redevelopment of 235 East Main Street in Griswold, Connecticut “the Site”).  The modification to such Authorization is to allow for the use of treated dredged sediment from the Site, stabilized by methods including, but not limited to, the PFTM process, as such engineered fill.  

All testing, recordkeeping and reporting requirements, and other conditions required by BUD-013 issued to the Applicant on December 24, 2020 will continue in force and effect. 

This modification of the Beneficial Use Determination Authorization will remain in effect until December 24, 2030.
