Application process: General permits & permit by rule
There are three main types of environmental permits for projects that may affect our state’s natural resources, environment and human health: individual permits, general permits and permit by rule. If the impact of a project’s activities on the environment are relatively minor, those activities may be authorized by DEEP through a general permit or permit by rule. Since the general permit process may be quicker and less costly, be sure to verify whether any of your activities may be eligible for authorization under a general permit or permit by rule before applying for an individual permit.Each general permit describes the necessary level of approval needed to initiate an activity, which can include one or more of the following:
- No registration is required prior to initiation of the activity;
- A registration is required along with written acknowledgement from DEEP prior to initiation of the activity (this registration may require certification of a professional engineer or qualified professional); or
- A registration is required along with DEEP approval prior to initiation of the activity (this registration may require certification of a professional engineer or qualified professional). In some cases, this approval will contain site-specific conditions in addition to those already contained in the general permit.
Certain activities may be authorized by DEEP through Permit by Rule, which are regulations implemented when impact of certain activities are minor. Only notification to DEEP is required before implementing the activity. Currently, the activities that are regulated through Permit by Rule address air quality for the following:
- Auto Body
- Boilers
- Combined Heat & Power
- Distributed Generators
- Emergency Engines
- Rock Crushers
- Solvent Degreasing
- Surface Coating
- Limit Potential to Emit - limitations on premises-wide actual emissions below a Title V source
