Changes Regarding Claimant's Attorney's Fees Guidelines - Effective January 1, 2024

Effective January 1, 2024, contingency fees related to the representation of claimants in the workers’ compensation forum will increase from 20% to 25%. All fees will continue to be subject to the approval of an Administrative Law Judge. Requests for fees in excess of 25% will not be considered. This increase in allowable fees shall not be applied retroactively and no renegotiation or amendments to prior executed fee agreements will be permitted.
Any fee agreements in effect prior to January 1, 2024, will remain subject to Memorandum No. 2001-03. All other applicable guidelines pursuant to Memorandum No. 2001-03, excluding the fee rate structure, will remain in effect after January 1, 2024.
