     A regular meeting of the Freedom of Information Commission was held on June 13, 2012, in the Freedom of Information Hearing Room, 18-20 Trinity Street, Hartford, Connecticut. The meeting convened at 2:15 p.m. with the following Commissioners present:

     Ira Alston participated via speakerphone. Attorney Kathleen Foster appeared on behalf of the respondents. The Commissioners unanimously voted to adopt the Hearing Officer’s Report. The proceedings were recorded digitally.

Elisabeth Seieroe Maurer v. Office of Corporation Counsel, City of Danbury; and City of Danbury
     Elisabeth Seieroe Maurer appeared on her own behalf. Attorney Johanna Zelman appeared on behalf of the respondents. Attorney Eric Chester appeared on behalf of the intervenor Danbury Firefighters Union, Local 801. Kenneth Ackell, an intervenor, appeared on his own behalf. The Commissioners voted, 6-0, to amend the Hearing Officer’s Report. The Commissioners voted, 6-0, to adopt the Hearing Officer’s Report as amended.*  Commissioner Shaw did not participate in this matter.  Commissioner London asked that the record reflect the stellar effort by Attorney Paula S. Pearlman in reviewing numerous in camera records in connection with this matter.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

Jody Waldron was granted Permission to address the matter on her own behalf.  The Commissioners voted, 6-0, to amend the Hearing Officer’s Report. The Commissioners voted, 6-0, to adopt the Hearing Officer’s Report as amended.* The  proceedings were recorded digitally. Commissioner Shaw did not participate in this matter.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
     Tracie C. Brown reported on the Appellate Court Decision in Lamberto Lucarelli v. Freedom of Information Commission et al. dated May 29, 2012
     Colleen M. Murphy reported on access-related legislation.

Elisabeth Seieroe Maurer v. Office of Corporation Counsel, City of Danbury; and City of Danbury
Paragraph 4 of the Hearing Officer’s Report is amended as follows: 
     4. It is also found that on or about February 23, 2011, the respondents provided notice to the 24 individuals [or their designees] referenced in paragraphs 2[a] and 2[b], above, of the complainant’s February 16th records request.  It is found that [20] 16 of the 24 individuals filed written objections to the disclosure of the records described in paragraph 2, above.  The [four] EIGHT individuals who did not file objections were Robert Blantin, Thomas Burke, Richard Gerlach, Sr., [and] DOUGLAS LYLE, BRUCE MICHALEK, Michael Pascuzzi, JAMES PATTON AND JAMES PEARCE.  (there remains a citation to footnote 2)

Footnote 2 of the Hearing Officer’s Report is amended as follows:

     The Hearing Officer’s Report is amended as follows:
     30. IT IS CONCLUDED, THEREFORE, THAT THE RESPONDENTS DID NOT VIOLATE THE FOI ACT AS ALLEGED BY THE COMPLAINANT IN PARAGRAPHS 2B, ABOVE.
     31. [30.] WITH RESPECT TO THE COMPLAINANT’S SEPTEMBER 6, 2011 REQUEST, [Furthermore,] it is found that while the respondent superintendent provided the instructions described in paragraph 12, above, it is found that it was not her intention to delay compliance with a request for a copy of only two pages.  It is found that the complainant scheduled his visit to the respondent superintendent’s office on the second day of school – just one business day after power had been restored to the area.  It is found that the respondent superintendent anticipated that the complainant would request volumes of copies on one of the busiest days of the school year.  It is found that it was reasonable for her to try to manage the work load that she reasonably anticipated her staff would be under on that day.   The respondent superintendent testified, and it is found, that had she been in the office at that time, she would have provided the complainant with a copy of the
requested record.
     [31. It is found that, while the administrative assistant showed a regrettable lack of judgment, it would not be in the interest of fairness to hold the respondents accountable in this regard.]
     [32. It is concluded, therefore, that the respondents did not violate the FOI Act as alleged by the complainant in paragraphs 2b and 2c, above.]     
     32. NONETHELESS, IT IS FOUND THAT COMPLIANCE WITH THE COMPLAINANT’S SEPTEMBER 6, 2011 REQUEST FOR A COPY OF JUST TWO PAGES WAS NOT PROMPT WITHIN THE MEANING OF §§1-210(A) AND 1-212(A), G.S.  
     33. IT IS ALSO FOUND THAT IT WAS THE RESPONDENT SUPERINTENDENT’S INSTRUCTIONS THAT PRECLUDED PROMPT COMPLIANCE WITH THE COMPLAINANT’S SEPTEMBER 6, 2011 REQUEST AND THAT HER INSTRUCTIONS SHOULD HAVE INCLUDED THE FACTORS FOUND IN ADVISORY OPINION #51 AS DESCRIBED IN PARAGRAPHS 21 AND 22, ABOVE. 
     34. CONSEQUENTLY, IT IS FOUND THAT THE RESPONDENTS VIOLATED THE DISCLOSURE PROVISIONS OF §§1-210(A) AND 1-212(A), G.S., BY FAILING TO PROMPTLY COMPLY WITH THE COMPLAINANT’S SEPTEMBER 6, 2011 REQUEST.  
     35.  The Commission declines to consider the complainant’s request for the imposition of a civil penalty.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
