The undersigned hereby certifies, on behalf of the Banking Commissioner (“Commissioner”), that:

1. On May 21, 2018, the Commissioner issued an Order to Cease and Desist, Order to Make Restitution, Notice of Intent to Fine and Notice of Right to Hearing (collectively, “Notice”) against James Ward Doyle (“Respondent”), a copy of the Notice is attached hereto and incorporated by reference herein;
2. The Order to Cease and Desist and Order to Make Restitution provided that they would remain in effect and become permanent against Respondent if a hearing was not requested within 14 days of their receipt;
3. On May 22, 2018, the Notice was sent by certified mail, return receipt requested, to Respondent at:  c/o Endeavor Management Solutions, LLC, 45 Rockefeller Plaza, 630 Fifth Avenue, 20th Floor, New York, New York 10111 (“New York, New York Mailing”); and 300 Highpoint Drive #403, Hartsdale, New York 10530 (“Hartsdale, New York Mailing”);
4. On May 25, 2018, Respondent received the New York, New York Mailing;
5. On June 4, 2018, the Hartsdale, New York Mailing was returned to the Department of Banking marked “Forward Time Exp – RTN to Send – Doyle – 20 Old Mamaronek Rd Apt 4G – White Plains NY 10605-2032”;
6. On June 18, 2018, a copy of the Notice was sent by certified mail, return receipt requested, to Respondent at 20 Old Mamaronek Road, Apt. 4G, White Plains, New York 10605-2032 (“White Plains, New York Mailing”);
7. On June 20, 2018, Respondent received the White Plains, New York Mailing;
8. Respondent has failed to request a hearing on the allegations set forth in the Order to Cease and Desist and Order to Make Restitution within 14 days of the date of their receipt; and
9. On July 6, 2018, the Order to Cease and Desist and Order to Make Restitution issued against Respondent became permanent.
