Burial Expense Adjustments
Payable for burial expenses associated with death resulting from an accident arising out of and in the course of employment or from an occupational disease.
Special Session Public Act No. 21-2 amended Section 31-306 of the Workers’ Compensation Act to increase the burial expense compensation from four thousand to twelve thousand dollars and adjust the compensation rate annually based on the consumer price index for urban wage earners and clerical workers (CPI-W) in the northeast, with no seasonal adjustment, as calculated by the United States Department of Labor's Bureau of Labor Statistics.
For all workers’ compensation deaths incurred on or after:
- January 1, 2024, the compensation rate for deaths covered under the Workers’ Compensation Act is $13,885.25 based on the overall 2022 CPI-W increase for the northeast of 3.2%.
- January 1, 2023, the compensation rate for deaths covered under the Workers’ Compensation Act is $13,454.70 based on the overall 2022 CPI-W increase for the northeast of 7.5%.
- January 1, 2022, the compensation rate for deaths covered under the Workers’ Compensation Act is $12,516.00 based on the overall 2021 CPI-W increase for the northeast of 4.3%.
