Petition for Declaratory Ruling 

Capital Preparatory Schools, Inc., and Capital Preparatory Middletown Charter School Planning Committee

Notice of the filing of a Petition for a Declaratory Ruling. Capital Preparatory Schools, Inc., and Capital Preparatory Middletown Charter School Planning Committee, Petitioners, filed a Petition for Declaratory Ruling with the State Board of Education (SBE) on March 18, 2025. The Petition requests that the SBE issue declaratory rulings on several issues. The general subject matter of the Petition is whether the SBE is required to rank charter school applicants that have received initial certificates of approval from the SBE in order to determine which one will be funded first. See Connecticut General Statutes (C.G.S.) Sections 10-66bb(a) and 10-66ee(k). The Petition requests eight separate rulings from the SBE. The reader is referred to the Petition for further information.

Notice of Decision to Issue a Declaratory Ruling

On May 7, 2025 the State Board of Education (State Board) resolved to issue a declaratory ruling on the eight issues set forth in the Petition for Declaratory Ruling filed on March 18, 2025 by Capital Preparatory Schools, Inc and Capital Preparatory Middletown Charter School Planning Committee (Petition). The Petition is posted on the Department of Education website on the Legal and Governmental Affairs page. The State Board further directed the Commissioner of Education through the Department of Education’s Division of Legal and Governmental Affairs to provide notice of this action to the public and interested parties and to convene a scheduling conference among the Petitioners and interested parties that have been granted party status in this proceeding. 

Persons who wish to be designated as a Party or an Intervenor should file a petition for such designation no later than June 13, 2025. See Regulation of Connecticut State Agencies Sec. 10-4-15. Parties and intervenor. Petitions may be filed with Attorney Louis Todisco, at Louis.Todisco@ct.gov.
