Gov. Malloy Statement Regarding Comments Made on the Floor of the Senate by Senator Fasano

(HARTFORD, CT) – Governor Dannel P. Malloy released the following statement regarding remarks made on the floor of the State Senate this afternoon by Senate Republican President Pro Tempore Senator Len Fasano concerning the nomination of Associate Justice Andrew J. McDonald to serve as Chief Justice of the Connecticut Supreme Court:

“Senator Fasano’s performance today should send a chill up the spine of every sitting judge in Connecticut. His antics run afoul of the tradition and decorum our General Assembly has followed since 1636. During that long history, no legislative leader, let alone a member of the Connecticut bar, has nitpicked, parsed, and deconstructed the decisions of a sitting judge more than Senator Fasano did today. His overtly political behavior and his desire to focus on the outcome of decisions rather than the qualifications of the nominee is the very antithesis of how legislators should handle judicial nominations.

“Senator Fasano’s charade not only defames the time-honored judicial selection process of the General Assembly, but also makes the Senator himself look small for stooping so low. I join legal scholars and respected attorneys – both Republicans and Democrats – in condemning this outrageous spectacle.

“It is now an undeniable fact that Andrew McDonald has been treated differently than others who came before him. It begs the question, what is different about Justice McDonald that so concerns Connecticut Republicans?”
