The above-captioned matter was heard as a contested case on September 19, 2011, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondents are public agencies within the meaning of §1-200(1), G.S.
2. By letter of complaint filed on June 8, 2011, the complainant appealed to the Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by failing to provide psychiatric and medical records concerning the confinement of Amy Archer Gilligan from 1924 to 1962 at what is now Connecticut Valley Hospital, following her conviction for second degree murder for the arsenic poisoning of a resident of her nursing home. (Mrs. Gilligan was an accused serial murderer credited as the “inspiration,” for lack of a better word, for the play “Arsenic and Old Lace.”)

3. It is found that the complainant first requested Gilligan’s records on August 3, 2010. The respondents at that time stated that the records had been destroyed. The respondents notified the complainant on May 12, 2011 that the records had been found, but they declined to release the medical and psychiatric records. Thirty pages of non-medical and non-psychiatric historical records were provided to the complainant, including information provided by State’s Attorney Hugh Alcorn; an inventory of clothing received with Gilligan on admission; correspondence with third parties, including acquaintances of Gilligan, insurance companies, and The Hartford Courant; and newspaper articles.

4. It is found that the respondents denied the complainant’s request for medical and psychiatric records on May 12, 2011.

5. Section 1-200(5), G.S., defines “public records” as follows:
     Public records or files means any recorded data or information relating to the conduct of the public's business prepared, owned, used, received or retained by a public agency, …whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.
6. Section 1-210(a), G.S., provides, in relevant part:
     Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to (1) inspect such records promptly during regular office or business hours, (2) copy such records in accordance with subsection (g) of section 1-212, or (3) receive a copy of such records in accordance with section 1-212.
7. Section 1-212(a), G.S., provides in relevant part:  “Any person applying in writing shall receive, promptly upon request, a plain, facsimile, electronic or certified copy of any public record.”
8. The requested records were submitted to the Commission for an in camera inspection. It is found that the withheld records consist primarily of psychiatric records and medical records.
9.  It is concluded that the records requested by the complainant are public records within the meaning of §§1-200(5), 1-210(a), and 1-212(a), G.S.
10. The respondents maintain that Gilligan’s psychiatric records are exempt from disclosure pursuant to §52-146e, G.S., which provides in relevant part:

     (a) All communications and records as defined in section 52-146d shall be confidential and shall be subject to the provisions of sections 52-146d to 52-146j, inclusive. Except as provided in sections 52-146f to 52-146i, inclusive, no person may disclose or transmit any communications and records or the substance or any part or any resume thereof which identify a patient to any person, corporation or governmental agency without the consent of the patient or his authorized representative.
11. Section 52-146d(2), G.S., defines such protected communications and records as follows:
"Communications and records" means all oral and written communications and records thereof relating to diagnosis or treatment of a patient's mental condition between the patient and a psychiatrist, or between a member of the patient's family and a psychiatrist, or between any of such persons and a person participating under the supervision of a psychiatrist in the accomplishment of the objectives of diagnosis and treatment, wherever made, including communications and records which occur in or are prepared at a mental health facility;
12. It is found that the following records withheld by the respondents fall within the definition set forth in §52-146d(2), G.S.

     a. The portion of the Admission Card (one page) setting forth a provisional diagnosis;
     b. A letter dated July 17, 1924 (one page) from Dr. P.B. Battey at Connecticut State Prison to Superintendent  R.L. Leak, M.D., at Connecticut State Hospital concerning Gilligan and Dr. Battey’s interviews with her;
     c. Admission, progress and annual notes detailing psychiatric interviews, observations and diagnoses by hospital psychiatric staff from July 17, 1924 to April 23, 1962 (42 pages1);

Pages 41 and 42, and a duplicate copy of page 40, are physically separated from the first 40 pages submitted to the Commission. Also, a second page numbered 42 (not the same document as the first page numbered 42) and a page numbered 44 (a partial duplicate of the second page 42) are similarly separated from the first 40 pages.

     d. A document dated August 4, 1924 entitled “Anamnesis,” relating information about Gilligan provided by Gilligan’s daughter to psychiatric staff of the hospital (5 pages);
     e. A document dated August 12, 1924 entitled “Additional Information,” relating information about Gilligan provided by one of Gilligan’s sisters to psychiatric staff of the hospital (4 pages);
     f. Correspondence dated September 18, 1929 from Gilligan’s daughter to Dr. Leak, the Superintendent at Connecticut State Hospital (3 pages)
     g. Correspondence dated January 17, 1929 from the Dr. Leak to a sister of Gilligan’s (1 page);
     h. Correspondence dated September 25, 1929 from Dr. Leak to Gilligan’s daughter (2 pages);
     i. Correspondence dated March 9, 1932 from Dr. Leak to Gilligan’s sister-in-law (1 page);
     j. Correspondence dated July 1, 1932 from Dr. Leak to Gilligan’s daughter (2 pages);
     k. Correspondence dated July 8, 1932 from Gilligan’s daughter to Dr. Leak (2 pages);
     l. Correspondence dated June 29, 1932 from Gilligan’s daughter to Dr. Leak.  (3 pages);
     m. Correspondence dated August 16, 1937 from Gilligan’s daughter to Dr. Leak;
     n. Correspondence dated August 20, 1937 from the Assistant Superintendent, Connecticut State Hospital, to Gilligan’s daughter (1 page);
     o. Summary by Dr. Felt dated August 8, 1924 (5 pages; 2 copies);
     p. The portions of the Patient Data forms that describe Gilligan’s “mental diagnosis.” (2 pages and 1 duplicate page).
13. It is concluded that the records described in paragraph 12, above, are exempt from disclosure pursuant to §52-146e, G.S., and that the respondents did not violate the FOI Act by withholding them from the complainant. 

14. The respondents contend that the following records are also exempt from disclosure pursuant to the psychiatrist-patient privilege:

     a. A document dated August 8, 1924 entitled “Additional Information,” consisting of a summary of information provided to a Connecticut State Hospital field worker by Dr. H.F. King, who had treated Gilligan for about five years before her arrest (6 pages). 
     b. An undated document entitled “Ward Admission Record” (1 page).
     c. a document in which Gilligan’s temperature, pulse, respiration, urine and stool are noted, and “clinical notes and physician’s orders” are noted on days from 1924 to 1933 (15 pages, not counting 5 blank pages)
     d. a document entitled “Ward Notes” consisting of unattributed medical observations of Gilligan from 1949 to 1962 (13 pages, not counting 1 blank page);
     e. a document entitled “Standing Orders” which notes medications and treatments, the doctor’s name, and the date the medications or treatments were discontinued (4 pages);
     f. eight one-page accident reports (8 pages);
     g. correspondence dated December 19, 1933 from the Superintendent to a Mr. A.P. Darling of the Metropolitan Life Insurance Company, describing Gilligan’s mental condition, her prognosis for recovery, and her ability to understand an ordinary business transaction (1 page);
     h. Correspondence dated December 16, 1938 from the hospital superintendent to Gilligan’s daughter (1 page);
     i. Correspondence dated April 13, 1939 from the hospital superintendent to Gilligan’s daughter (1 page);
     j. Correspondence dated August 9, 1939 from the hospital assistant superintendent to Gilligan’s daughter (1 page);
     k. Correspondence dated February 25, 1946 from Gilligan’s daughter to the hospital superintendent (2 pages);
     l. Correspondence dated February 28, 1946 from the hospital superintendent to Gilligan’s daughter;
     m. An April 23, 1962 “Visit or Discharge” form stating the basis for Gilligan’s discharge from CVH (1 page);
     n. A memo dated August 1st, year not given, to a Dr. Shurgast (1 page)
     o. An untitled page giving the date, time, and cause of Gilligan’s death (follows the pages numbered 42 and 422 described in footnote (1 page);
15. It is found, however, that the documents described in paragraph 14, above, are not “communications and records thereof relating to diagnosis or treatment of a patient's mental condition between the patient and a psychiatrist, or between a member of the patient's family and a psychiatrist, or between any of such persons and a person participating under the supervision of a psychiatrist in the accomplishment of the objectives of diagnosis and treatment, wherever made, including communications and records which occur in or are prepared at a mental health facility” within the meaning of §52-146d, G.S. Some of the records are communications with third parties, such as Gilligan’s physician prior to her arrest, or the representative of an insurance company, and most do not relate to the diagnosis or treatment of Gilligan’s mental condition.
16. It is therefore concluded that the respondents violated the FOI Act by failing to disclose the records described in paragraph 14, above. (As described below, these records are not exempt from disclosure as medical records.)
17. The respondents contend that two documents are exempt from disclosure pursuant to §1-210(b)(10), G.S., which provides in relevant part that disclosure is not required of “communications privileged by the attorney-client relationship.”
18. The applicability of the exemption contained in §1-210(b)(10), G.S., is governed by established Connecticut law defining the privilege.  Maxwell v. FOI Commission, 260 Conn. 143 (2002).  In Maxwell, the Supreme Court stated that §52-146r, G.S., which established a statutory privilege for communications between public agencies and their attorneys, merely codifies “the common-law attorney-client privilege as this court previously had defined it.” Id. at 149.
19.  The respondents contend the remaining redactions are permitted pursuant to §1-210(b)(10), G.S., which provides that disclosure is not required of “communications privileged by the attorney-client relationship.” 
20.   Section 52-146r(2), G.S., defines “confidential communications” as:

     all oral and written communications transmitted in confidence between a public official or employee of a public agency acting in the performance of his or her duties or within the scope of his or her employment and a government attorney relating to legal advice sought by the public agency or a public official or employee of such public agency from that attorney, and all records prepared by the government attorney in furtherance of the rendition of such legal advice. . . .
21. The Supreme Court has also stated that “both the common-law and statutory privileges protect those communications between a public official or employee and an attorney that are confidential, made in the course of the professional relationship that exists between the attorney and his or her public agency client, and relate to legal advice sought by the agency from the attorney.”  Maxwell, supra at 149.
22. The two records that the respondents claim are privileged are (1) a November 10, 1955 letter from the hospital superintendent to an Assistant Attorney General seeking legal advice (1 page); and (2) a November 17, 1955 letter from the Assistant Attorney General providing that advice (2 pages).
23.  After a careful review of the in camera records, it is concluded that the two records are privileged, and that the respondents did not violate the FOI Act by withholding them.
24. With respect to the remaining records withheld from the complainant (including those described in paragraph 14 and found not to be privileged psychiatric records in paragraph 15), most of which are on their face medical records, the respondents claim the records contain medical information protected from disclosure pursuant to §1-210(b)(2), G.S., and the federal Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), Pub.L. No. 104-191, 110 Stat. 1936 (1996).
25. It is found that HIPAA applies to any entity that is: a health care provider that conducts certain transactions in electronic form; a health care clearinghouse; or a health plan.  It is found that an entity that is one or more of these types of entities is a "covered entity" required to comply with HIPAA.  45 C.F.R. 160.103, 45 C.F.R. 164.502.
26. The Commission takes administrative notice of the fact that CVH is a health care provider that conducts certain transactions in electronic form.  It is found, therefore, that CVH is a covered entity required to comply with the HIPAA regulations.
27. 45 C.F.R. 164.512(a)(1) provides in relevant part that:
     A covered entity may use or disclose protected health information to the extent that such use or disclosure is required by law and the use or disclosure complies with and is limited to the relevant requirements of such law.
28. 45 C.F.R. §164.103 defines “required by law” as:
     a mandate contained in law that compels an entity to make a use or disclosure of protected health information and that is enforceable in a court of law [which includes]…, but is not limited to … an administrative body authorized to require the production of information … and statutes or regulations that require the production of information….
29. It is concluded that the FOI Act requires by law the disclosure of non-exempt requested records, within the meaning of 45 C.F.R. §164.103. See State of Nebraska ex re. Adams County Historical Society v. Kinyoun, 277 Neb. 749 (2009), Abbott v. Texas Department of Mental Health, 212 S.W.3rd 648 (Tex. 2006); State ex rel. Cincinnati Enquirer v. Daniels, 108 Ohio St.3d 518, 2006 (state public records laws which require disclosure of records are not in conflict with HIPAA privacy rule exceptions, even for covered entities).
30. It is found that HIPAA does not bar disclosure of the medical information contained in the in camera records.
31. It is concluded that HIPAA is not a “federal law” that exempts the requested medical records from disclosure pursuant to §1-210(a), G.S.   See Priscilla Dickman v. Director, Health Affairs Policy Planning, Department of Community Medicine and Health Care, State of Connecticut, University of Connecticut Health Center; Docket #FIC2009-541 (July 28, 2010) (¶¶38-45); Robin Elliott v. Commissioner, State of Connecticut, Department of Correction; Docket #FIC2008-507 (July 22, 2009) (¶¶76–85); Lucarelli v. Old Saybrook et al., Docket #FIC 2010-068 (¶17).
32. The respondents also maintain that Gilligan’s medical records are exempt from disclosure pursuant to §1-210(b)(2), G.S., which provides that disclosure is not required of “[p]ersonnel or medical and similar files the disclosure of which would constitute an invasion of personal privacy.”
33. The Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S., in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993).   The claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that the disclosure of such information is highly offensive to a reasonable person.  The Commission takes administrative notice of the multitude of court rulings, commission final decisions1, and instances of advice given by the Commission staff members2, which have relied upon the Perkins test, since its release in 1993.
34. The general rule under the FOI Act is disclosure, exceptions to this rule must be narrowly construed, and the burden of establishing the applicability of an exemption clearly rests upon the party claiming the exemption.  New Haven v. FOIC, 205 Conn. 767, 775 (1988); Superintendent of Police v. FOIC, 222 Conn. 621 (1992); Ottochian v. FOIC, 221 Conn. 393 (1992).
35. The Supreme Court, in Perkins, supra, construed the term “invasion of personal privacy” according to its common-law meaning and adopted the definition for invasion of privacy set forth in 3 Restatement (Second) Torts Section §652I of the Restatement provides, in relevant part, that a claim “ . . . for invasion of privacy can be maintained only by a living individual whose privacy is invaded.” The commentary accompanying §652I provides that in the absence of statute, an action for invasion of privacy cannot be maintained after the death of the individual.
36. It is concluded, therefore, that disclosure of the requested medical records would not be an invasion of personal privacy, because no such privacy right exists with respect to the deceased. See  Crowley v. Commissioner, State of Connecticut, Department of Public Health, Docket #FIC 2007-123 (August 8, 2007); and David K. Jaffe v. State of Connecticut, Connecticut Lottery Corporation Docket #FIC1999-019 (April 29, 1999). (Disclosure of deceased employee’s personnel files would not be an invasion of privacy because privacy rights terminate at death.)
37. Even if Gilligan’s privacy rights survived her death in 1962, her medical records are a legitimate matter of public concern, and disclosure of them would not be highly offensive to a reasonable person.
38. First, the Commission takes administrative notice of the fact Gilligan was a very public figure about whom legitimate public interest remains. The complainant asserts, without contradiction, in his September 19, 2011 written statement:

     There is already an extensive official public record about Mrs. Gilligan. At the State Library, you will find a five-count indictment for murder, a hundred-page coroner’s inquest report, a 1,000-page transcript of her first trial, a hundred-page judge’s finding prepared for the Supreme Court, the state and defense appeal briefs, and a Supreme Court ruling—an an equally if not more extensive record of secondary sources in the public domain. The fact that the Library has preserved these records and made them available to the public is testament to their historic significance and their value to future researchers, two criteria laid out in statute to guide acquisitions by the State Archives.

     Given the extent of the record in the public domain, there would seem to be very little we do not know about Mrs. Gilligan.

     But the records I have requested, and only these records, can answer some very important questions.

     What was the true nature of her disease?

     Was her reported morphine addiction the result of becoming addicted to what was then a legal pain killer she used to treat the physical manifestations of an underlying disease?

     Were her large purchases of arsenic for therapeutic and not criminal use?

     What sort of treatments did she receive at the hospital, and are they considered effectual by today’s standards?

     The functioning of our judicial system and how we care for the mentally ill are issues of legitimate public concern, even in retrospect.
39. Second, the Commission finds that it would not be highly offensive to disclose the medical records of a notorious serial murderer who has been dead for 50 years.
40. It is therefore concluded that Gilligan’s medical records are not exempt from disclosure pursuant to §1-210(b)(2), G.S., and that the respondents violated the FOI Act by failing to provide such records to the complainant.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. Forthwith, the respondents shall provide to the complainant all of the requested records not found to be exempt in this decision.

AFFIDAVIT OF ERIC V. TURNER
Eric V. Turner, having been duly sworn, does hereby depose as follows:
1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.
2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.
3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).
4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.
5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.
6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.
7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.
8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.
9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
