     A regular meeting of the Freedom of Information Commission was held on October 8, 2014, in the Freedom of Information Hearing Room, 18-20 Trinity Street, Hartford, Connecticut. The meeting convened at 2:10 p.m. with the following Commissioners present:
     Commissioner Owen P. Eagan, presiding

     Also present were staff members, Colleen M. Murphy, Mary E. Schwind, Victor R. Perpetua, Tracie C. Brown, Kathleen K. Ross, Lisa F. Siegel, Valicia D. Harmon, Paula S. Pearlman, Cindy Cannata, and Thomas A. Hennick.
     The Commissioners unanimously voted to approve the minutes of the Commission’s regular meeting of September 24, 2014.
     Those in attendance were informed that the Commission does not ordinarily record the remarks made at its meetings, but will do so on request.

     Junior Jumpp participated via speakerphone. Attorney Nancy Canney appeared on behalf of the respondents. The Commissioners unanimously voted to adopt the Hearing Officer’s Report. The proceedings were recorded digitally.

     Attorney Gregory Conte appeared on behalf of the respondents. The Commissioners unanimously voted not to grant the complainant’s motion for a continuance in the matter. The Commissioners unanimously voted to deny the complainant’s motion to reopen the matter. The Commissioners unanimously voted to adopt the Hearing Officer’s Report.      The Commissioners unanimously voted to table Consideration of Notice of Decision Not to Schedule in David Godbout v. Executive Director, State of Connecticut, Freedom of Information Commission; and State of Connecticut, Freedom of Information Commission, Docket # FIC 2013-750. The proceedings were recorded digitally.
     Colleen M. Murphy reported that no action would be necessary in a request for Declaratory Ruling from David Godbout, dated August 29, 2014 because the request had been withdrawn. The proceedings were recorded digitally.
     The Commissioners unanimously voted to authorize Attorney Valicia D. Harmon to settle the CV-11-6009196-S, Commissioner, Department of Public Safety v. Freedom of Information Commission, and the Associated Press case by agreeing that the §1-215 issue would be sustained and the §29-15 issue would be dismissed.
     Victor R. Perpetua reported on pending appeals

AMENDMENT
Juan Maldonado v. Commissioner, State of Connecticut, Department of Correction; and State of Connecticut, Department of Correction
     The order in the Hearing Officer’s Report is amended as follows:
     1.  The respondents shall within four weeks of the date of this Decision perform a diligent and thorough search of the off-site database of e-mails for records responsive to the complainant’s request and provide any records retrieved to the complainant free of charge; WITH RESPECT TO THE EMAILS OF COMMISSIONER DZURENDA, THE RESPONDENTS SHALL HAVE SIX WEEKS FROM SUCH DATE TO PERFORM SUCH SEARCH AND PROVIDE SUCH RECORDS.

     2.  The respondents shall within four weeks of the date of this Decision perform a diligent and thorough search of the e-mails of the named staff members, including determining that the search encompasses all the e-mails for 2013 and all the staff members’ electronic e-mail files; WITH RESPECT TO THE EMAILS OF COMMISSIONER DZURENDA, THE RESPONDENTS SHALL HAVE SIX WEEKS FROM SUCH DATE TO PERFORM SUCH SEARCH AND PROVIDE SUCH RECORDS.
