Conduct that constitutes potential violations of the Connecticut Antitrust Act includes, but is not limited to:
- Price fixing agreements (an agreement among competitors to raise, fix, or otherwise maintain the price at which their goods or services are sold)
- Bid rigging agreements (i.e., bid suppression, "cover" bids or bid rotation schemes)
Customer to Territorial Allocation Agreements – these schemes, sometimes known as “property rights” systems, are agreements in which competitors divide markets among themselves. In such schemes, competing firms allocate among themselves specific customers or types of customers, products, or geographic territories.
Health CareConduct that constitutes fraud, waste or abuse includes, but is not limited to:
- Billing for services not rendered
- Providing unnecessary services
- Billing for non-covered services as covered services
- Billing for more expensive services than those that are necessary (“upcoding”)
- Billing separately for services that should be bundled together at a lower rate ("unbundling")
- Duplicate billing
- Altering a claim, or altering a document support a claim like a certificate of medical necessity Falsifying cost reports
- Providing or receiving something of value (cash, gifts, services) in return for services or referrals for services (i.e. kickbacks)
- Billing for brand-name drugs when generic drugs are dispensed
Competition among businesses generally leads to higher quality products and lower prices for consumers. Unfair competition refers to business practices that are misleading, deceptive or that otherwise undermine informed consumer choice. Such conduct deprives consumers of the benefits of a competitive market and unfairly disadvantage businesses that play by the rules.
Workers' CompensationExamples include:
- Staging Accidents
- Physicians who bill for but do not render services
- Injured workers who collect temporary total benefits for their state job yet work another job
- Billing for more time than was actually spent with a patient or double billing
Department of Social Services Programs Mental Health or Substance Abuse Prevention Programs
Department of Developmental Services (DDS) Programs
- Billing DDS for services not provided.
- Double Billing DDS or DDS individuals for the same service paid by another program.
- Using DDS funds to purchase items that are not DDS allowed by DDS.
- Charging DDS individuals higher rates than those established by DDS.
- Abuse or Neglect of a person with intellectuals and developmental disabilities.
