Petition – a claim that a health professional or institution under the jurisdiction of the Department of Public Health has violated a statute, regulation, Memorandum of Decision or Consent Order.

Memorandum of Decision a decision issued by a Board, Commission, or the Commissioner or his designee, after a full evidentiary hearing; the decision is subject to a 45-day appeal period.

Consent Order – an order issued by a Board, Commission, or the Commissioner or his designee, adopting an agreement reached between a licensee and the Department of Public Health which imposes discipline upon the license.

Voluntary Surrender of License Affidavit – an agreement between a licensee and the Department of Public Health wherein the licensee agrees to surrender his or her license and the Department agrees to dismiss its petition concerning the licensee. The licensee also agrees that if he or she seeks licensure in the future, the allegations contained in the petition shall be deemed true.

Voluntary Agreement not to Renew or Seek Reinstatement – an agreement between a licensee and the Department of Public Health wherein the licensee agrees not to renew or seek reinstatement of his or her license, and the Department agrees to dismiss the petition. The licensee also agrees that if he or she seeks licensure in the future, the allegations contained in the petition shall be deemed true.

Prelicensure Consent Order – an Order reached by agreement between an applicant for a license and the Department of Public Health. As part of such an Order, the applicant and Department agree that the applicant will be issued a license that is subject to specified conditions. If the Order is due to the fact there is a pending complaint against the applicant in another state, the Connecticut Order will become null and void if no action is taken in the other state.

Reinstatement Consent Order –either (1) an Order reached by agreement between an applicant whose license has lapsed and the Department of Public Health, or (2) an Order issued by a Board, Commission, or the Commissioner or his designee, adopting an agreement between the Department and an applicant whose license was previously revoked. As part of such an Order, the applicant is issued a license subject to specified conditions.

Summary Suspension – an Order issued by a Board, Commission, or the Commissioner or his designee, immediately suspending a license based on imminent danger to the public health and safely, violation of the terms of an existing Consent Order, an action taken against the licensee in another state, or conviction of a felony.

Summary Probation – an Order issued by a Board, Commission, or the Commissioner or his designee, based on an action taken against the licensee in another state or conviction of a felony.
