Decision and Order
On December 9, 2003, the Applicant, Message Center Management, Inc. (MCM), filed an application for the construction, maintenance and operation of a 140-foot monopole telecommunications facility in the southwest portion of Glastonbury, Connecticut. MCM amended the application on April 1, 2004, proposing to increase the height of the proposed tower to 170 feet above ground level to accommodate the coverage requirements of AT&T Wireless PCS LLC d/b/a AT&T Wireless, an intervenor to the application. On April 6, 2004, MCM requested that the Connecticut Siting Council (Council) postpone, to a date uncertain, the hearing scheduled for this application due to the withdrawal of AT&T Wireless’ intervention in this docket.
The provisions of Connecticut General Statute § 16-50p requires the Council to render a decision on a telecommunications application within 180-days of receipt. The statute allows the Council to extend the deadline for a decision an additional 180-days. The deadline for a decision on this application, including a 180-day extension, is December 3, 2004.
On November 3, 2004, MCM requested that the Council grant a six-month extension of time to render a decision on this application to allow MCM to present new information regarding a telecommunications carrier that intends to locate at the proposed site.
Because a full record was not developed for consideration on this application and Connecticut General Statues preclude an extension of time beyond 360-days to render a decision in this matter, the Council denies without prejudice a Certificate of Environmental Compatibility and Public Need for the for the construction, maintenance and operation of a wireless telecommunications facility at the Casella Property, east of Main Street (Route 17), Glastonbury, Connecticut.
By this Decision and Order, the Council disposes of the legal rights, duties, and privileges of each party named or admitted to the proceeding in accordance with Section 16-50j-17 of the Regulations of Connecticut State Agencies.
