May an employee possess cannabis on the employer's premises?

It depends on the employer's written policies.

  • Possession of medical marijuana by a qualifying patient certified to have an approved condition by a practitioner is protected conduct.
  • Under the law, adults 21 years of age or older may possess up to 1.5 ounces of cannabis on your person and up to 5 ounces of cannabis in a locked motor vehicle glove box or trunk. However, employers are not required to allow an employee to “possess” cannabis while performing duties or on the premises of the employer, i.e., in a locked glove box or trunk of a motor vehicle parked on the employer’s premises.
  • An employer may implement a policy prohibiting the possession, use or other consumption of cannabis by an employee while on the employer’s premises.
