What do cannabis retail establishments need to do to continue to sell THC-infused beverages?

If you are a cannabis retail establishment (dispensary facility, hybrid retailer, or retailer) you may offer THC-infused beverages for retail sale. No further action is needed.

Container Fee

Pursuant to Section 6(c) of Public Act 24-76, “On October 1, 2024, and every six months thereafter, each dispensary facility, hybrid retailer or retailer shall remit payment to the department for each infused beverage container and legacy infused beverage container sold during the preceding six-month period.”

A fee of $1 is due on October 1, 2024 for each infused beverage and legacy infused beverage container sold from June 15, 2024 through September 30, 2024. To pay the container fee, log into your eLicense account and use the “License Maintenance” function found at the top of the screen. The sale of legacy infused beverages on or after October 1, 2024 is prohibited (Section 30(b) of Public Act 24-76).
