What do cannabis retail establishments need to do to continue to sell THC-infused beverages?

If you are a cannabis retail establishment (dispensary facility, hybrid retailer, or retailer) that has THC-infused beverages for retail sale:

  • To sell THC-infused beverages through June 30, 2024:
    • On May 14, 2024: Count the number of containers of THC-infused beverages you have in your possession, even product that is no longer intended for sale.
    • By June 15, 2024:
      • Report to the Department of Consumer Protection the number of containers of THC-infused beverages identified in their May 14, 2024 inventory. Link: How to Report Your Inventory
        • Example: Four-pack of cans counts as four containers.
      • Pay a $1 fee each infused beverage container reported in the inventory.
    • To report your inventory and pay the fee, log into your eLicense account and use “License Maintenance” on or after May 14, 2024, but not later than June 15, 2024. When you report your inventory in eLicense, you must pay the related fee.
    • If you have multiple locations, you must conduct and report a separate inventory for each location.
    • You must pay the fee by June 15, 2024.
  • To sell legacy THC-infused beverages on or after July 1, 2024:
    • A legacy THC-infused beverage contains no more than one milligram of THC per serving and no more than five milligrams of THC per container.
    • To continue to offer legacy THC-infused beverages for retail sale from July 1, 2024 through September 30, 2024, you must be granted a waiver by the Department. When you report the results from your May 14, 2024 inventory, you may also request the waiver in eLicense. If you do not request a waiver, you cannot continue selling the THC-infused beverages you had in stock that fail to comply with the new THC limit and labeling requirements.
