Can licensed cannabis establishments sell hemp products?

Public Act 23-166 allows for the sale of hemp manufacturer products at licensed dispensary facilities, hybrid retailers and retailers. Manufacturer hemp products sold at licensed cannabis establishments must be: 

 

  • Stored separately from cannabis;
  • Physically separate from any cannabis in a display area; 
  • Displayed with approved signage
  • Tested by a laboratory that meets the standards for accreditation and testing, and sampling methods; 
  • Clearly labeled to distinguish the product as (i) a manufacturer hemp product, (ii) subject to different testing standards than cannabis or marijuana, and (iii) not cannabis or marijuana; and, 
  • Sold in accordance with state laws and regulations.
