How many times can I apply for a license through the lottery application process?

As of June 26, 2023, applicants may only submit one application per application period for each license type. Eligible social equity applicants may submit one application in both the social equity lottery round as well as the general lottery round. If the Department determines that an applicant has submitted more than one application in either the social equity or general lottery round, all applications submitted by such applicant for that round will be disqualified. Lottery fees are non-refundable, including fees for disqualified applications. (Section 25 of Public Act 23-79)


DCP cannot award a license to any applicant selected through the lottery that already has two or more licenses of the same type, or in the same license category at the time the lottery is conducted.

 

DCP also cannot award a license to any applicant that includes a backer that has managerial control of two or more licensees of the same type or category, or is a backer of two or more licensees of the same type or license category at the time the lottery is conducted.


Dispensary facility, retailer and hybrid retailer licenses are within the same license category. Producer, cultivator and micro-cultivator licenses are within the same license category.


A “Backer” is any individual that has a direct or indirect financial interest in a Cannabis Establishment, and (1) owns 5% or more together with their spouse, parents, or child, OR (2) participates directly or indirectly in the control, management, or operation of the Cannabis Establishment. 


All lottery application fees are non-refundable.
