BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Carolyn Futtner called the meeting to order at 10:06am.
Chairman Futtner read the Introductory Statement and called the roll call. Six appellants were present, four appellants failed to appear. Four Local Issuing Authorities were present along with the State.
Board Members Present: Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad, Elbert Gray, Det. Gudrun Johnson, Col. Chris Lewis, Chief, Carl Rosensweig.
Board Members Absent: Col. Kyle Overturf and Atty. Stephen Sanetti
Chairman Carolyn Futtner administered the oath to all witnesses.
Hearings: Ten cases were heard in the following order:
1) Case No. 22-632-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Town Counsel Mary Pokorski represented the Local Issuing Authority, Chief Matthew Marino, New Britain Police Department with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 6-0 in favor of the Local Issuing Authority.
2) Case No. 22-631-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Alaric Fox represented the Local Issuing Authority, Chief Alaric Fox, Enfield Police Department with 5 witnesses.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 6-0 in favor of the Local Issuing Authority.
3) Case No. 22-368-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Doug Sauve’ represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board member Det. Johnson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously.
4) Case No. 22-333-SD, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Doug Sauve’ represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board member Det. Johnson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
5) Case No. 22-341-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Doug Sauve’ represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board member Det. Johnson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously.
6) Case No. 22-287-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant and Atty. Williams failed to appear. Lt. Doug Sauve’ represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board member Det. Johnson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously.
7) Case No. 20-394-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Doug Sauve’ represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board member Det. Johnson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
8) Case No. 22-182-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Doug Sauve’ represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.
Decision: By a majority decision, the Board voted in favor of the appellant and ordered the state to reinstate the permit. Chairman Atty. Futtner, Dr. Conrad, Mr. Gray and Col. Lewis, voted in favor of the Appellant. Det. Johnson and Chief Rosensweig voted in favor of the State Issuing Authority. Vote was 4-2 in favor of the appellant.
9) Case No. 22-475-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time. Vote was 6-0 in favor of the Local Issuing Authority.
10) Case No. 23-707-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Justin Hilchuk represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 6-0 in favor of the Local Issuing Authority.
Case No. 22-341-R has been reopened The appellant was sitting in the hearing room, but did not check in with the Office Manager.
Chairman Futtner agreed to open up the appeal and allow the appellant to withdraw his case due to an active Risk Warrant.
Secretary’s Report:
Board member Dr. Conrad made a motion to accept the minutes from October 19, 2023, seconded by Mr. Gray. motion carried. Det. Johnson and Col. Lewis abstained. Vote 4-0-2 to approve.
