Call to Order

Chairman Carolyn Futtner called the meeting to order at 10:02am.

Chairman Futtner read the Introductory Statement and called the roll call.  Nine appellants were present, two appellants failed to appear. Eight Local Issuing Authorities were present along with the State.

Board Members Present: Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad, Mr. Elbert Gray, Col. Chris Lewis, Chief Carl Rosensweig, and Stephen Sanetti, Esq.

Board Members Absent: Ms. Gundrun Johnson and Col. Kyle Overturf

Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Eleven cases were heard in the following order:

1) Case No. 21-778-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Mark M. Kratter, Esq. The appellant failed to appear however Atty,Kratter was present and asked for a continuance. This request was granted with no objections.  DESPP Legal Staff Attorney Matt Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Continued: This case was continued to August 17, 2023.

2) Case No. 22-293-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Ofc. Jason Anderson represented the Local Issuing Authority, Chief Ed Lennon, East Haven Police Department.

Withdrawal: The appellant withdrew her case.

3) Case No. 22-300-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Tpr. Muckle represented the Local Issuing Authority, First Selectman Robert McGarry, Town of Haddam.

Motion: Board member Dr. Conrad made a motion for the appellant, due to lack of evidence. Motion was seconded by Atty. Sanetti, motion passed unanimously. Motion was 6-0 in favor of the appellant.

4) Case No. 22-225-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Jason Anderson represented the Local Issuing Authority, Chief Ed Lennon, East Haven Police Department.

Withdrawal: The appellant withdrew his case, East Haven will issue the permit.

5) Case No. 22-250-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Brian Weir represented the Local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 6-0 in favor of the Local Issuing Authority.

6) Case No. 21-230-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Matthew Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered the state to reissue.   Chairman Futtner, Dr. Conrad, Mr. Gray, Col. Lewis, and Chief Rosensweig voted in favor of the Appellant. Atty. Sanetti voted in favor of the Local Issuing Authority. Vote was 5-1 in favor of the appellant.

7) Case No. 21-306-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Matt Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board member Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.

8) Case No. 22-247-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Dep. Chief Donald Olson represented the Local Issuing Authority, Chief Scott Sansom, East Hartford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of pistol permit.

9) Case No. 22-149-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Dep. Chief Donald Olson represented the Local Issuing Authority, Chief Scott Sansom, East Hartford Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered East Hartford to issue.   Chairman Futtner, Dr. Conrad, Mr. Gray, Col. Lewis, and Atty. Sanetti voted in favor of the Appellant. Chief Rosensweig voted in favor of the Local Issuing Authority. Vote was 5-1 in favor of the appellant.

10) Case No. 22-267-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Laukaitis represented the Local Issuing Authority, Chief Kevin Glenn, North Haven Police Department.

Withdrawal: The appellant withdrew his case.

11) Case No. 22-304-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Joseph Legen represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered Stratford to issue. Dr. Conrad, Mr. Gray, Col. Lewis, and Atty. Sanetti voted in favor of the Appellant. Chairman Futtner and Chief Rosensweig voted in favor of the Local Issuing Authority. Vote was 4-2 in favor of the appellant.

 

Secretary’s Report:

Board member Dr. Conrad made a motion to accept the minutes from April 27, 2023, seconded by Atty. Sanetti. motion carried. Vote 6-0 to approve.
