BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, two appellants failed to appear. Nine local Issuing Authorities and the State were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Carolyn Futtner Esq., Dr. Cynthia Conrad, Gudrun Johnson, Col. Chris Lewis, Chief Carl Rosensweig and Stephen Sanetti, Esq.

Board Members Absent: Anthony Iaconis, Esq.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Eleven cases were heard in the following order:

1) Case No. 21-168-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Ofc. Massimo Piroli represented the Local Issuing Authority, Chief Kevin Halloran, North Branford Police Department.

Withdrawal: The appellant withdrew his case.

2) Case No. 21-200-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Withdrawal: The appellant withdrew his case.

3) Case No. 22-609-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Withdrawal: The appellant withdrew his case.

4) Case No. 20-602-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief Kristian Lindstrom represented the Local Issuing Authority, Chief Kristian Lindstrom, South Windsor Police Department.

Motion: Board member Chief Rosensweig made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

5) Case No. 20-354-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Ofc. Massimo Piroli represented the Local Issuing Authority, Chief Kevin Halloran, North Branford Police Department.

 

Decision: By a majority decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Chairman Blando, Board Secretary Futtner, Dr. Conrad, and Chief Rosensweig voted in favor of the Local Issuing Authority. Ms. Johnson, Col. Lewis and Atty. Sanetti voted in favor of the Appellant. Vote was 4-3 in favor of the Local Issuing Authority.

6) Case No. 19-691-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Staff attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Motion: Board member Chief Rosensweig made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

7) Case No. 20-621-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.. Ofc. Massimo Piroli represented the Local Issuing Authority, Chief Kevin Halloran, North Branford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered North Branford to issue his permit. 

8) Case No. 19-690-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Staff attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of his pistol permit.

9) Case No. 20-640-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Det. Mark Williams represented the Local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and order Danbury to issue his permit. 

10) Case No. 20-640-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ryan Scapelletti, Esq.  Det. Mark Williams represented the Local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Motion: Board Member Johnson made a motion for the appellant due to lack of evidence. Motion was seconded by Secretary Futtner, motion passed unanimously.

11) Case No. 21-073-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Withdrawal: The appellant withdrew his case knowing Hamden would issue. 

 

Secretary’s Report:

Ms. Johnson made a motion to accept the minutes from August 5, 2021, seconded by Board Secretary Futtner. Board Secretary Futtner withdrew her motion as she was not at the August 5, 2021 hearing.  The motion was then seconded by Chief Rosensweig. Motion carried.  Board Secretary Futtner and Dr. Conrad abstained
