BOARD OF FIREARMS PERMIT EXAMINERS

Virtual Hearing

 

 

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Three appellants were present, one appellant failed to appear. Four local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. Cynthia Conrad, Carolyn Futtner Esq., Anthony Iaconis, Esq., and Chief Carl Rosensweig.

Board Members Absent: Gudrun Johnson and Mr. M. Peter Kuck

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Eight cases were heard in the following order:

1) Case No. 19-364-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with 1 witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

2) Case No. 19-464-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear for the hearing.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Futtner, motion passed unanimously.

3) Case No. 21-009-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Chief William Fitzgerald represented the Local Issuing Authority, Chief William Fitzgerald, Winchester Police Department.

Continued: This case has been continued to May 6, 2021.

4) Case No. 20-559-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Marshall Porter represented the Local Issuing Authority, Chief Marshall Porter, Glastonbury Police Department with one witness.

Withdrawal: The appellant withdrew his case as he has moved to a different town.

5) Case No. 20-579-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Cpt. Garon DelMonte represented the Local Issuing Authority, Chief Keith Mello, Milford Police Department.

Withdrawal: The appellant withdrew his case as he has moved to a different town.

6) Case No. 20-456-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by his attorney Ralph D. Sherman, Esq.  Officer Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Motion: Board Secretary Overturf made a motion to vote in favor of the appellant due to lack of evidence, seconded by Dr. Conrad. Motion carried.

7) Case No. 21-013-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Continued: This case has been continued to May 6, 2021.

8) Case No. 21-036-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Leopold Clarke represented the Local Issuing Authority, Chief Jason Thody, Hartford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Hartford to issue the appellant his pistol permit. 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from April 1, 2021, seconded by Board member Futtner. Atty. Futtner withdrew her motion as she left the hearing early. Dr. Conrad seconded the motion, motion carried.

New Business:

 

1) Chairman Blando allowed Col. Overturf to reopen Case # 20-659-D as the appellant tried to get into the hearing on April 1, 2021 and was unable to.  Stratford was also notified.

 

2) Case #18-053-D has been sent up to the Supreme Court for final ruling in this case where an out of state case can be considered as an equivalent case to CT State laws.

 

3) The Board will revisit going back to in-person hearing on June 3, 2021 hearing.
