BOARD OF FIREARMS PERMIT EXAMINERS

Virtual Hearing

 

 

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Six appellants were present, two appellants failed to appear. Six local Issuing Authorities and the State were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. Cynthia Conrad, Carolyn Futtner Esq., Anthony Iaconis, Esq., Gudrun Johnson and Chief Carl Rosensweig

Board Members Absent: Mr. M. Peter Kuck.

Hearings: Eight cases were heard in the following order:

1) Case No. 20-509-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by James A. Saraceni, Esq.. Lt. Kevin McKellick represented the Local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Withdrawal: The appellant withdrew her case.

2) Case No. 20-649-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department

Withdrawal: The appellant withdrew his case.

3) Case No. 19-360-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with 1 witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

4) Case No. 20-535-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Ryan Pfieffer represented the Local Issuing Authority First Selectman George Temple, Town of Oxford.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

5) Case No. 20-659-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Det. Joseph Legen represented the Local Issuing Authority, Chief Joseph McNeil Stratford Police Department.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Iaconis, motion passed unanimously.

6) Case No. 20-252-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Gregory J. Miller, Esq.  Lt. Lee Grabner represented the Local Issuing Authority, Chief Spencer Cerruto, New Milford Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Chairman Blando voted in favor of the appellant.  Board Secretary Overturf, Dr. Conrad, Atty. Futtner, Atty. Iaconis and Chief Rosensweig voted in favor of the Local Issuing Authority. Vote 5-1 in favor of the Issuing Authority.

7) Case No. 19-460-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with 1 witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

8) Case No. 20-445-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Ryan Pfieffer represented the Local Issuing Authority First Selectman George Temple, Town of Oxford.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Oxford to issue the pistol permit.

 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from March 18, 2021, seconded by Dr. Conrad, motion carried. Attorney Iaconis abstained from the vote.
